General: Based on observation and interview, the following was found: On 03/13/25, the surveyor conducted an onsite investigation. The surveyor arrived at approximately 12:30 pm and toured the child-care center and playground. At approximately 12:40 pm, the surveyor found that there were twenty-six (26) children ages three to-five-years-old on the playground with two (2) staff members. The surveyor noted the class was over group size by two (2) children. Based on interview, a staff member stated they had been over group size since 11:45 am, and they would soon receive another child. At approximately 12:47 pm, a child was picked up, which left the class over group size by one (1) child. The surveyor noted that a third staff member was in Classroom #11 but was on her way outside. It a should be noted, the children’s classroom (Classroom #11), has a square footage capacity of nineteen (19) children. The staff member in charge indicated that at she thought she was in compliance because she had three (3) staff members present with the group of children. While the staff member had the door open notifying the playground staff, a separate toddler had placed her finger in the crease/hinge of the doorway. A review of video footage shows that on 8/14/17 at approximately 9:20 AM a group of children ages two to three (2-3) years sitting on the carpet doing motions to a song. A female teacher is sitting in a chair in front of the group and an additional female teacher is sitting on the floor behind the group of children. At approximately 9:28:34 AM the teacher sitting in the chair reaches down, grabs the feet of a three-year-old male child and turns him. As the staff person does this the child attempts to back away from the staff person who then reaches and grabs the child by his left arm and left leg and then grabs his hands and yanks him up and sets him down roughly on the carpet. At 9:28:41 AM the same staff person then grabs the child by his hands and violently swings him to her left. As she swings him around his entire body is parallel to the floor. The child’s forehead slams into the wall behind the teacher. The child immediately reaches up with his little hand, touches his forehead, and appears to be crying. The teacher, who had one (1) hand on the child reaches around with her other hand and while gripping under his forearms pulls the child into a sitting position. At 9:28:48 AM the child tries to get away and the teacher grabs him and then pulls him roughly onto her lap. The child is observed holding his hands over his eyes and appears to be crying. At 9:29:17 AM the teacher puts him on the carpet in front of her and he is observed sitting on his bottom with his head down. It is important to note that a second teacher who was sitting on the floor behind the group of children observed the entire incident with no reaction or attempt to intervene. This was the child's first day in this classroom. An interview with the director found that she viewed the video footage of the incident with the staff and the three-year-old child on the evening of 8/14/17. General: Based on Review of Documentation, the facility failed to maintain a written record for each child containing identifying information about the child, contact information, the name of each person who is designated in writing to pick up the child, the child’s general health status and medical history, the name and phone number of each person to be contacted in an emergency situation involving or impacting the child, and authorization by the parent for the child care center to seek emergency medical care for the child in the parent’s absence. A review of enrollment paperwork for children enrolled on 06/21/2011, 08/04/2013 and 08/08/2011, showed that the three (3) children were included on the same written record. The facility did not obtain a written record for each child separately. The staff person in charge reported that the children are siblings and the parents did not complete separate enrollment forms for each child. The facility also failed to obtain written permission form the parent for third party professional services in the child care facility. At the time of survey, six (6) children were observed participating in an activity with a third party professional from Happy Feet LLC in classroom six (6). The third party professional was alone with the children and maintained supervisory control over the group of children. The third party professional maintained records of children signed in and out of the activity while the third party professional conducted supervisory control over the children. The staff member in charge at the facility stated that Happy Feet LLC has provided service in the facility for almost one (1) year. The staff member in charge stated that parents must register their children for the program, however, the facility had not obtained written permission from the parents that allow Happy Feet LLC to conduct the activities with the children.
