The surveyor observed a step up onto the wooden deck/platform that resulted in the pool wall measuring approximately three (3) feet high. The pool was observed to contain a cover. During interview with staff-in-charge, the surveyor learned that the children present at the child-care center on 03/16/23 were four-years-old to five-years-old. General: Based on Observation, and interview, the child care center failed to maintain a child-care program that assures each child will be provided with adequate supervision at all times by a qualified staff person who ensures the child is within scope of vision and range of voice unless the child is school age. Observation revealed a child was allowed to leave the class area of the home and go to use the bathroom located down the hallway from the classroom. The child went unsupervised while staff remained in the classroom. The child was completely out of the staff's scope of vision and range of voice (the bathroom door was closed and the classroom was very loud with children) for approximately three (3) minutes. Interview with staff indicated that she has always allowed children to go the bathroom unsupervised because it was safer than her leaving all of the other children alone while she took one child to the bathroom.

Review of documentation revealed no substiture staff person identified. During the subsequent interview with the Director she argued that according to 922 KAR 2:110 she was not required to have a substitute because the reguation allowed for closure of the center in the event she could not provide care. The regulation reads: "(9) If the operator of a Type II child-care center is unable to provide care in accordance with this administrative regulation, 922 KAR 2:090, or 922 KAR 2:120, the Type II child-care center shall close temporarily until the operator is able to resume compliance." The Director further argued that she has never had a substitute. I advised the Director that the regulation she was referring to was not fully encompassing with regards to having a subsitiute staff person available.
