General: Based on interview, the surveyor found that a staff person inappropriately handled several children in the classroom that she worked in while employed at the child-care center. The surveyor learned through multiple interviews and through documentation provided by the director, that the staff person had acted in the following manner: grabbed a three-year-old child by the arm to bring him back into the classroom, at this time, his feet dangled off the floor, she also pushed a two-year-old down onto a cot and held the child down, to keep her onto the cot during nap time, and the staff person restrained a two-year-old child while on the playground by using her legs for approximately one (1) to two (2) minutes; therefore, the health, safety and comfort of the children was compromised. During interview with staff-in-charge, she stated that the staff person mentioned had been terminated from her job as of 10/25/24.

General: Based on observation, the surveyor observed a child from Room Seven leave the room and walk through an area that connects with Room Eight. The child entered Room Eight at 12:01 pm. The child walked from Room Eight back into the adjoining area and attempted to play in the sink. The child then returned to Room Eight and was playing around a small play structure. The surveyor observed the staff member from Room Seven enter Room Eight to retrieve the child and return with the child to Room Seven at 12:04 pm. The surveyor estimates that the staff member left the remaining six (6) children unsupervised for approximately thirty (30) to forty-five (45) seconds while retrieving the child from Room Eight. Therefore, the child-care center failed to provide adequate supervision by ensuring the children were within scope of vision and range of voice at all times. General: Based on multiple interviews with staff, the surveyor learned that a one-year-old child exited the playground through an opening at the bottom of the playground fence. Approximately one-minute after the child exited the playground, the child was found by a witness who returned the child to staff inside the child care center. During interview, the surveyor learned that on 05/02/23, there were three (3) staff members and twenty-two (22) children ranging in age from one to two (1-2) years old on the playground. The staff members went inside the building individually to put out cots for nap time while the other staff remained on the playground. One (1) staff person went inside the building at approximately 11:18 a.m. - 11:20 a.m. to put out cots and take a child to the restroom, leaving two (2) staff on the playground with the remaining twenty-one (21) children. The staff person did not return to the playground until approximately 11:39 a.m. Based on review of documentation and interview with staff, the surveyor found that the staff person logged a diaper change on Brightwheel at 11:20 a.m. During the timeframe of the staff person being inside, another staff person went inside the building, the exact time was unknown, to take a child to the restroom, leaving one (1) staff person with the remaining children on the playground. Through interview with staff, the surveyor learned that the staff person left on the playground was going to log the diaper change for the other staff person; however, the staff person found that a one-year-old child had recorded a video on her phone. At 11:27 a.m., the staff person posted that video of the child on Brightwheel. During this time, the same one-year-old child exited the playground through an opening under the playground fence. Through interview with staff, the surveyor learned that the staff person on the playground did not witness the one-year-old child escape. The surveyor learned that a video, of the staff person on the playground, was taken by a witness at approximately 11:28 a.m. The witness also found the one-year-old child standing on the other side of the playground fence. Based on review of the video footage, the one-year-old child was standing in the grassy area in front of a vinyl privacy fence. The staff person was sitting under a child sized yellow canopy on the playground and was looking down during the video. Based on review of pictures taken of the opening under the fence, the surveyor found that the opening measured approximately twenty-nine (29) inches long and was higher on one (1) end and lower on the other end of the opening. The highest point of the opening measured approximately six and three-fourths (6 3/4) inches and the lower point of the opening to measure approximately four (4) inches.
