General: Based on interview and review of documentation, on 05/20/2026 at approximately 10:50 a.m., a staff member and her class of eight (8) children were transitioning from the preschool playground into the gym when a three-year-old male child slipped out of line, entered the smaller playground area, and began riding a tricycle. Another staff member, who is also the child’s mother, observed the child from the lobby window and immediately went outside to retrieve him. The staff-in-charge stated that the staff member responsible for the class failed to complete a name-to-face count prior to entering the building. That staff member did not realize the child was missing until conducting a head count in the gym. By that time, the child’s mother had already retrieved him. General: Based on interview and review of documentation, the childcare center failed to provide for the health, safety, and comfort of the children in their care. From 01/17/25 through 04/30/26, there were numerous documented incidents of a child choking, hitting, kicking, smacking, biting and stabbing with a pencil, children in the childcare center. Despite a large number of incident reports and a failed behavior plan, the childcare center has allowed the child to continue to harm other children. As a result, on 04/30/26, a child was choked by this same child and received scratches and bruises to the neck area. The childcare center has continued to allow the two (2) children to remain in the same classroom and has not initiated any action to protect the children in their care from this child. He reported that a lady stopped her car in the middle of the road, got out of her car, and prevented the child from going any farther. The staff person went outside and found the child with the lady who had stopped her car. The staff person in charge escorted the child back to her classroom and notified the child’s grandmother. General: Based on interview and review of documentation, on 5/24/2021 at 5:20 p.m. the facility sent notification to the DRCC Eastern Branch that Child #1 was injured at the facility on 5/20/2021 after slipping on plastic toys keys the children had dumped on the floor. Child #1 would cry when trying to stand and put weight on his right leg. The facility contacted Child #1’s parents and informed them of what happened. Interviews with staff and Child #1’s parent found the facility was informed when Child #1 was picked up at the facility that Child #1 would be taken to the pediatrician for evaluation. Further interview found that the parent contacted the facility on the way to the pediatrician’s office and spoke with staff to obtain more detail of what happened to assure all information could be given to the pediatrician. The parent contacted the facility later that evening and stated Child #1’s leg was not broken. However, the parent stated Child #1 had hyper-extended his knee and would not be at the facility on 5/21/2021. On 5/24/2021 the parent contacted the facility and informed them a radiologist had contacted them late on 5/21/2021; the radiologist told them Child #1 had a buckle fracture and should be taken to the emergency room to have a cast put on Child #1’s leg. The parent also asked if the facility staff could care for Child #1 at the facility while the child is in the cast. Child #1 was brought to the facility for care on 5/24/2021. A review of the submitted incident report confirms the incident happened on 5/20/2021. The facility was informed the same day by the parent at least twice that Child #1 would be taken to the pediatrician for evaluation. The facility was also contacted by the parent the same day after the child had been to the pediatrician. The facility did not report the incident to the Division of Regulated Child Care within 24 hours as required by this regulation.
