On 09/14/18, the child-care center transported four-year-old and five-year-old children on a cart/trolley that had no safety restraints or other mechanisms to protect children from injury. General: Based on interviews, the center transported four-year-old and five-year-old children in a cart/trolley on 09/14/18. The transportation took place on the premises of the child- care center. An All-Terrain Vehicle (ATV) was connected to the cart/trolley and pulled the cart/trolley from the child-care center building to the on premises soccer field. The director drove the ATV while the children and a caregiver rode in the cart/trolley. During the transport back to the child-care building, eleven (11) four-year-old and five-year-old children and a caregiver were in the cart/trolley at approximately 10:00 a.m. The ATV driver made a turn, from the grassy area onto the pavement. When the turn was made, the railing on the front side broke. The railing weld, attached to the floor, broke on both sides and the railing gave way. A four-year-old female child and a five-year-old male child were holding the front railing and fell from the moving cart/trolley onto the pavement. The five-year-old male received a minor cut to his head and abrasions, and received first aid treatment on site. The four-year-old female received first aid treatment on site until the ambulance arrived, and was then transported to a local hospital. Within an hour of arrival to the local hospital, the female child was airlifted, by helicopter, to a children’s hospital in Nashville, TN. Interview determined the four-year-old female received a skull fracture and deep lacerations to forehead; deep lacerations to left thigh; a severed left, ring finger which was reattached; 2nd degree abrasions on her right shoulder, both knees and both hips, and bruising on both hips. Review of records and interviews determined none of the children had written parent permission to be transported in a cart/trolley. In addition, this incident occurred at approximately 10:00 a.m. on 09/14/18, but the center did not notify the cabinet until 2:22 p.m. (via email) on 09/18/18, which was not within the required twenty-four (24) hour timeframe of an incident requiring medical treatment. Interviews determined a local person made the cart/trolley, twelve (12) to thirteen (13) years prior to the incident on 09/14/18. The child-care center had used the cart/trolley during previous activities but did not notify or obtain prior approval from the cabinet to transport child-care children in the cart/trolley.
