A second caregiver was in the same room with the three year old child but was not in close proximity to prevent the injury from occurring. Once the three year old child screamed, this alerted the caregiver who was in the same room with the three year old child. This caregiver walked toward the three year old child and observed the three year old child’s finger inside the hinge side of the door as the two year old child opened and closed the half door. The two year old child opened and closed the door two (2) to three (3) times before the caregiver reached the children to intervene. Both caregivers immediately responded but the three year old child sustained an approximate inch wide, deep cut in the first crease of his right pointer finger. Medical treatment at the local emergency room was sought and 11 stiches were required to close the cut. General: Based on review of documentation, the director failed to supervise staff to ensure implementation of policies/procedures. A driver, employed 6/1/01, left a child, unattended on the center's van for approximately forty-five (45) minutes on 4/29/13. The center's policy states: "According to Kentucky state regulations all children shoud be within scope of vision and range of voice. Employees must account for all children at all times, failure to account for children that they may be responsible for may result in disciplinary action."

The driver unloaded the children from the van and walked inside the center at 3:15 p.m. A child was later discovered sitting on the van in the center's parking lot at 4:00 p.m. on 4/29/13.
