General: Based on review of documentation and video observation dated 4/13/21, a caregiver harshly grabbed a four-year-old child’s right leg and right arm and turned the child to lay on her left side while on a cot. The caregiver pointed her finger at the child two (2) times and covered the child with a blanket. Interview determined the caregiver's reaction was because the child did not sleep at naptime. The center’s Positive Guidance Protocol stated, “Staff will work together to create a positive environment for all children in the classroom. Creating a positive environment includes but is not limited to stating expectations clearly in a positive way and using positive guidance when responding to challenging behaviors.” The caregiver did not implement the center’s behavior policy. Also, staff members failed to immediately report suspected child abuse. The staff members were informed the evening of 4/13/21 and the Cabinet received the report at 8:31 a.m. on 4/16/21. General: Based on observation, review of documentation and interview, a three-year-old male child was left, unsupervised for one (1) minute and forty-eight (48) seconds outside on the fenced playground on 6/25/19. Two (2) staff, hire dates 8/13/15 and 9/8/16, supervised four (4), three-year-old children on the fenced playground on 6/25/19. The staff member with the hire date of 8/13/15 walked two (2) children inside the center at 1:50 pm for pick-up leaving the staff member with the hire date of 9/8/16 outside on the fenced playground with two (2) children. One (1) child, with a feeding tube, began to choke and gasp for breath; therefore, the staff member with the hire date of 9/18/16 carried her inside to classroom D. The father of the child who choked, met the staff member hired on 9/18/16 as she entered classroom D from the playground. Observation of the center’s video recording, staff member hired 9/8/16 was observed to stand at the counter in the center and hold an IPad. The staff member then walked to the area where the parent stood, sat down on a small activity table and spoke with the father of the child as he put the child in her car seat. At approximately 2:00 pm another parent entered classroom D and appeared to notify the staff member hire date 9/8/16, a child was unsupervised on the playground. The caregiver pulled the blanket off the boy’s head and observed the four (4) year old girl was lying on her stomach with her pants down and her bottom exposed.
