Additional staff who were not present at the facility also made attempts to reach the child's parents and emergency contacts. At approximately 5:57 p.m. the child's mother contacted the facility and stated she had fallen asleep and slept through her alarm. She also stated she could come and get the child and indicated she would notify the child's father she would be picking up the child. The child's mother arrived at the facility sometime between 6:40 and 6:45 p.m. The staff person stated she thought the mother’s breath smelled different and had a mint stench or smell. The staff person also stated the mother stumbled over some laundry baskets that were in the area. The mother then went out the door of the facility and left with the child. The staff person stated she did not look outside to see if the mother was driving the car or if someone was with her. The staff person admitted she had concerns with the behavior the mother exhibited while at the facility but allowed the mother to leave with the child. A review of the facility's policy for pick up found if there are concerns that a parent may be under the influence of drugs or alcohol staff cannot withhold a child from a parent but should delay the parent and contact another emergency contact to pick up the child. The policy also indicates that staff should notify the local police and Child Protective Services. A review of the pickup policy in the parent handbook found that the policy indicates that the facility can deny release of a child to an individual if the staff are concerned the individual is under the influence of drugs or alcohol. An interview with the staff person who stayed with the child found the only policy she was aware of was that staff could not keep a child from a parent regardless of their condition. The classroom was observed to be out of ratio for approximately ten (10) minutes. Once the children finished eating breakfast, they were separated into the appropriate age groups and proper ratios were restored. The staff person in charge also stated that the facility will cook ravioli for the children if the parents forget to pack a lunch.
