General: Observations on 04/27/2022 and 04/29/2022 revealed one-year-old children were present in the Ones classroom without a staff member present in the classroom or providing supervision of the children. On 04/27/2022, observation of the Infant classroom revealed two (2) staff members in the room with eight (8) infants. Upon the Division of Regulated Child Care (DRCC) representative's entrance into the Infant room, one (1) of the staff members quickly exited the room and entered an adjoining room where six (6) toddlers were sleeping on mats without a staff member in the room. Not all of the sleeping toddlers were within the scope of vision and range of voice of the staff members who were in the Infant classroom. The amount of time during which the toddlers were not provided with adequate supervision is unknown. During a subsequent visit to the center on 04/29/2022, two (2) staff members were present in the Infant classroom with seven (7) infants and toddlers. There were five (5) one-year- old toddlers present in the adjoining classroom with no adult present in the room. Four (4) of the one-year-old toddlers were sleeping on cots and one (1) was in a crib. One (1) of the staff members in the Infant room claimed responsibility for the toddlers upon being asked who was supervising the sleeping toddlers. Not all of the sleeping toddlers were within the scope of vision and range of voice of the staff members in the Infant room as they were moving about the room caring for other children. The amount of time during which the toddlers in the adjoining room were not provided with adequate supervision is unknown. Additionally, further observation of the Infant room on 04/29/2022 revealed an eight-month-old infant sleeping in a car seat with a bottle laying on him/her. The car seat awning was pulled over the infant and the car seat was placed in a dark corner of the room, facing the wall. The infant was out of the scope of vision of the staff members in the room. One (1) staff member acknowledged that she failed to account for the infant who was in the dark corner when she verbally provided a number of children in the room. One (1) of the staff members claimed supervisory responsibility of six (6) one- year-old children who were in an adjoining room without another adult. Therefore, two (2) staff members were caring for fourteen (14) infants and toddlers, exceeding the minimum staff to child ratio by four (4) children. When one (1) of the staff members entered the Ones classroom with the toddlers, one (1) staff member remained in the Infant room with eight (8) infants, exceeding the minimum staff to child ratio by three (3) infants. During a subsequent visit on 04/29/2022, two (2) staff members were present in the Infant room with seven (7) infants and toddlers ranging from two (2) months to one (1) year old. There were five (5) one-year-old children in an adjoining room without an adult in the room. Therefore, the two (2) staff members who were in the Infant room were responsible for twelve (12) infants and toddlers, exceeding the minimum staff to child ratio by two (2) children. Interviews revealed that a staff member made a chain out of three (3) large rubber bands and attached one end of the chain to a toddler's hair. The toddler's pacifier was attached to the other end, creating a dangling, retractable suspension strand that was a safety hazard for the toddler. Additionally, auditory observation from inside the office on 05/20/2022 revealed the sounds of an infant crying for several minutes. Observation of the Infant room revealed an eleven-month-old infant lying face down on the carpet while crying. One (1) of the staff members in the room was changing another child's diaper, while the second staff member in the room was sitting in a rocking chair looking at the crying child, without attempting to soothe the infant. The sitting staff member eventually got up and approached another infant who had pulled up on a bouncer seat. The staff member retrieved the infant that was near the bouncer seat and placed that child in the seat and buckled him/her up before she approached the crying infant. When the staff approached the crying infant, she sat the infant upright and attempted to pick him/her up. In the process, the infant fell back and hit his/her head. General: Based on observation, the child care center failed to maintain an outdoor play area in accordance with regulatory requirements. The space for the outdoor play area was not sufficiently fenced. There was a large opening in the fence line, allowing entry into the playground.
