Observation revealed a small fish tank in the two-year-old classroom that contained a live "Beta" fish. A large aquarium was also observed in the foyer that contained numerous live fish. Review of ten (10) children’s records revealed no written parental consent allowing animals in the presence of a child in care in any of the children's records. General: Based on Observation, and interview, the child care center failed to maintain an outdoor play area in accordance with regulatory requirements. Based on observation, an area in the older children's playground contained a semi-circle area, which contained mulch. Based on an interview, a staff member explained the area had been used as a sandbox but had been converted and mulch had been inserted. The area was designated by stakes of railroad ties. Seven (7) of the stakes had rotted, leaving pointed, sharp and jagged edges. The stakes were not easily seen protruding from the ground and were not in a specified line, with some leaning inward and some outward, creating a tripping hazard for the children - especially for the two (2) year old children which also use this area, based on an interview with the staff person.

Continued observation revealed that one (1) infant was awake in a crib against the half wall and out of the scope of vision of the two (2) staff members responsible for the infants for at least three (3) minutes. Continued observation of the staff members revealed that one (1) staff member was sitting on the floor close to the half wall, the other staff member was sitting on the floor feeding two (2)children on the other side of the classroom, making the infant in the crib out of the scope of vision of the staff members. Interviews with staff members revealed the age group in the room was one (1) years old to two (2) years old. Continued interviews with staff members revealed the child had been transitioned to the room for all day care for approximately one (1) week one. Further staff member interviews with staff members revealed that since the child was getting ready to turn two (2) years old that it was acceptable to allow the child to be grouped in with two (2) year olds.
