Review of the child care center’s daily schedule revealed the children would be served snack from 3:45p.m. to 4:30p.m. At 4:30p.m. the children and staff members were observed going outside to the playground. The surveyor asked a staff member when snack was going to be served to the children and he/she stated that, “The children will not be served snack today, it is too pretty outside, we are going outside today and if they want snack the children can get it as they leave.” The staff member was observed pushing a metal food storage locker outside beside the child care center’s entry door and leaving it. When a parent came to pick-up their child, the child was told to get a snack if they wanted one. Therefore, the children were not served snack. General: Based on observation, the child care center failed to comply with regulations regarding staffing requirements. Upon survey at 4:00 p.m., observation in the cafeteria revealed fifty-three (53) children in the age range of five-years-old to nine-years-old in the care of the staff in charge and a qualified staff member with the hire dates of 09/11/2017 and another staff member with the hire date of 10/16/2018. The minimum staff to child ratio was exceeded by eight (8) children. The maximum group size was exceeded by twenty-eight (28) children. At 4:10 p.m. observation in the cafeteria revealed thirty-two (32) children in the age range of five-years-old to nine-years-old in the care of a qualified staff member with the hire date of 09/11/2017 and a staff member with the hire date of 10/16/2018. The minimum staff to child ratio was exceeded by two (2) children and the maximum group size was exceeded by two (2) children. From the time of 4:10 p.m. to 4:11 p.m., the staff member walked out of the cafeteria into the gym out of scope of vision and range of voice. Leaving thirty-two (32) children in the age range of five-years-old to nine-years-old in the sole care of the qualified staff member. At that time, the minimum staff to child ratio was exceeded by seventeen (17) children. At 4:34 p.m. the qualified staff member terminated her employment at the child care center and walked off of the premises, leaving now fifty-three (53) children in the age range of five-years-old to nine-years-old in the care of the staff in charge and a staff member, until 5:12pm when another qualified staff member arrived at the child care center. The minimum staff to child ratio was exceeded by twenty-three (23) children until the third staff member arrived; at which time the minimum staff to child ratio was exceeded by eight (8) children.
