The items were accessible to children. Older Ones' Classroom: 1. The corners of a rectangular area rug were curled upwards, creating a tripping hazard. 2. An electrical outlet adapter with multiple outlets contained one (1) unprotected outlet and two (2) unprotected USB ports. Preschool Classroom: 1. A metal, elongated electrical panel located on the wall above the baseboard was secured with duct tape. The duct tape failed to adequately close the box, resulting in a capped wire protruding from the panel and a sharp corner of the metal protruding outward. 2. General: Based on observation, interview and review of documentation, the child care center failed to assure compliance with regulatory requirements specific to the current pandemic as established in 922 KAR 2:405e. In accordance with Section 4 (1) (b) of the referenced regulation, the maximum group size shall be fifteen (15) children per group for children age twenty-four (24) months and older. Obervation revealed sixteen (16) children in the school age room, exceeding the maximum group size by one (1) child. Additionally, twelve (12) school age children were present. Interview with the staff in charge revealed eight (8) or nine (9) more school age children were expected to arrive. Interview with staff members revealed some school age childen will pariticipate in non-traditional instruction, NTI, school work for part of the day; however, there are times that all school age children may be together in one room. Additionally, in accordance with 922 KAR 2:405e Section 4 (3), each child shall remain in the same group throughout the day without interacting with another group. Review of the staff schedule and daily attendance records, interview with staff present, and observation of children and staff present confirmed that all children who arrive between 5:00a.m. and 6:00a.m. were gathered together in the toddler room with the sole staff member present. At 6:00a.m., a second staff member arrived and took the older children to the school age classroom. All children who arrived between 6:00a.m. and 7:00a.m were cared for in one (1) of the two (2) open classrooms by one (1) of the two (2) staff members who were present. Additional staff members arrived at 7:00a.m., at which time, children were dispersed to their assigned classrooms. Therefore, children from varying groups were permitted to interact with each other. In accordance with 922 KAR 2:405e Section 4 (7), a provider shall reduce the number of staff each classroom of children interacts with each day and create a schedule in which the same staff work with the same children each day as able. Review of the staff schedule and observation revealed that the teacher for the two-year-old children arrives at 6:00a.m. and retrieves the older children, four-years-old and older, from the sole staff member present prior to her arrival and takes the children to the school age room while the younger children, to include the two-year-old children, remained with the other staff member. Upon the arrival of additional staff members at 7:00a.m., the two-year-old teacher then retrieved the two-year-old children and took them to the two-year-old classroom for the remainder of the day. Therefore, as the schedule was written and implemented, the two-year-old children were in the care of multiple teachers as opposed to the assigned teacher staying with the younger children upon her arrival.
