Based on continued observation, all of the children were then placed into the seats of the bucket table. Three children were observed chewing on crayons without the staff member observing. Continued observation revealed that when the staff member became aware the children were putting the crayons into their mouths, the staff member simply recanted innumerable times, "No, we don't eat crayons!" The staff member would take the crayon away from the child and replace it with another crayon. Based on observation during lunch time in the one year old room revealed another staff member who forcefully pushed a child's legs down into the bucket seat, when seating her at the table, rather than positioning the child to slide into the seat. The child was returned to his class on the playground when the surveyor made the staff in charge aware of the fact that the child was unsupervised in the kitchen area. Also, based on interviews, during the morning transition time on 05-20-13 a one-year-old child walked down the steps toward the basement with the school age children and fell down the last few steps, which resulted in a cut above his eye. Interview with the two staff members who were present at the time revealed that neither of the staff members were aware of the child walking down the steps with the older children until another child told them, at which time the one-year-old child was already midway down the steps.

Classrooms: Based on observation, at 8:32a.m. on 7/23/12, ten (10) children were observed in the Four/Fives classroom with the eleventh (11th) child arriving at 8:33. Review of the facility's file at the DRCC office revealed a total acceptable capacity for the referenced classroom based on measurements to be no more than eight (8)children. Therefore, there was not thirty-five (35) square feet of space for each child that was present in the classroom. Further review of the facility's file at the DRCC office revealed that the center was cited for the same deficiency during an investigation on 4/20/12. The center's Plan of Correction for that deficiency stated "This preschool class has temporarily moved to the three year old class room, which is big enough for 12 children to occupy that space and that is this groups current enrollment. However, once the space is opened up with minimal construction, it will become one space large enough for the preschool classroom". Further review of the Plan of Correction revealed the following, "The adjustment to pre-existing space, to allow for the children to move back to their original classroom will be completed by July 6. If the project takes longer than expected, the children will remain in their temporary space until their original space has completed transformation. Once this takes place, it will no longer be considered two spaces, but one". At the time of the observation during the inspection on 7/23/12, it did not appear as if any alterations to the existing space had been initiated. Interview with staff members confirmed that no structural changes had been initiated or implemented.
