General: Based on observation and interview, between 8:00 am to 8:26 am, there were three (3) staff members present. The number of children increased as children continued arriving. The children remained grouped together as children continued arriving, resulting in up to forty-one (41) children being in one group. The youngest child was five (5) years old. Therefore, the maximum group size, per regulatory standards, was exceeded by up to eleven (11) children until the forty-second (42nd) child arrived and the children were divided into smaller groups. Prior to the children being divided into smaller groups, one (1) of the three (3) staff members frequently left the room to greet children at the door and allow them entrance, resulting in exceeding the minimum staff-to-child ratio per regulatory standards. The following staff-to-child ratios were observed during the observation: 1) Two (2) staff members and thirty-two (32) children, exceeding minimum staff-to-child ratio by two (2) children; 2) Two (2) staff members and thirty-three (33) children, exceeding minimum staff-to-child ratio by three (3) children; 3) Two (2) staff members and thirty-six (36) children, exceeding minimum staff-to-child ratio by six (6) children; 4) Two (2) staff members and thirty-seven (37) children, exceeding minimum staff-to-child ratio by seven (7) children; 5) Two (2) staff members and thirty-nine (39) children, exceeding minimum staff-to-child ratio by nine (9) children; 6) Two (2) staff members and forty-one (41) children, exceeding minimum staff-to-child ratio by eleven (11) children; 7) After the children were split into two (2) separate groups, one (1) staff member was observed caring for twenty-one (21) children within the gym. The youngest child was five (5) years old. Therefore, the minimum staff-to-child ratio was exceeded by six (6) children.

Based on observation, the child-care center failed to comply with staffing requirements. At 4:00 pm on 9/27/19, there were four (4) staff members present in the cafeteria area. One (1) staff member who was over eighteen years of age was responsible for a group of eleven (11) children, ranging from five to six years of age; the second staff member who was under eighteen years of age was responsible for a group of ten (10) children ranging from seven to eight-years of age; the third staff member was responsible for a group of five (5) children ranging from nine to to twelve years of age; and the fourth staff member was overseeing the children taking bathroom breaks. (Please note that the the fourth staff member supervised the bathroom breaks by standing in the doorway of the cafeteria and watching the children individually line up outside the bathroom, which was located across the hallway from the doorway of the cafeteria. At approximately 4:10 pm, a staff member who was over eighteen years of age was responsible for supervising the group of eleven (11) children ranging from five to six years of age left the cafeteria area to cover the front entrance area of the school. At this time, the fourth staff member continued to supervise the bathroom breaks by standing in the doorway of cafeteria. In addition, the fourth member took on the duty of supervising the group of children ranging from five to six years of age in the cafeteria. Furthermore, the fourth staff member was also checking children out of the child care center via an electronic device when their parents/approved pickup persons arrived. Moreover, as acknowledged in an interview, the fourth staff member disclosed that she was also supervising the two (2) above-mentioned staff members who were under eighteen years of age. During the time period of 4:10 pm through 4:29 pm, there were numerous occasions where the children from five to six years of age were observed leaving their designated age group to converse and play with children from other groups. When the fourth staff member noticed these issues while simultaneously performing the other duties mentioned, she corrected the children’s behavior in a professional manner. At 4:24 pm, the second staff member, who was responsible for a group of ten (10) children ranging from seven to eight years of age, was supervising a line of children waiting to receive their snack boxes; however, two (2) children from this group wandered into the hallway. At approximately 5:00 pm, the first, second and third staff members mentioned above took their respective groups to the outside playground. At 5:25 pm, the surveyor observed that the children were involved in activities as one (1) group as opposed to three (3) separate and distinct groups. Furthermore, interviews with staff revealed that the child care center does not delineate groups on the outside playground; therefore, all the children are allowed to engage in activities as one (1) group. Consequently, based upon the totality of facts described above, the child care center failed to maintain the minimum staff-to-child ratios and maximum group sizes based upon ages repeatedly throughout the survey. Observation of the cafeteria at 3:15 pm revealed a staff member with a hire date of 2/1/19 was the only staff member present and caring for an eleven (11) year old child. Continued observation throughout the survey revealed the aforementioned staff member had sole supervisory control over groups of children ages five (5) through eleven (11) while escorting them from the school bus and into the cafeteria, and also when taking them to the restroom. Review of documentation revealed the aforementioned staff member was seventeen years old; therefore, the aforementioned staff member was not under the direct supervision of a qualified staff person at all times during the survey while supervising children. General: Based on observation, the child care center director failed to assure compliance with regulatory requirements. Observation of the cafeteria revealed a very chaotic environment. Children ran throughout the room on many occasions during the survey, including one occasion in which several children chased each other with cups of water. Several children were observed to intentionally trip over baskets containing backpacks, seemingly unnoticed by any of the staff members. The staff member in charge attempted unsuccessfully to gain the children's attention multiple times throughout the survey; therefore the safety of the children was compromised because the group of children could not be managed.
