General: Based on observation and interviews, the child care center staff denied the cabinet unannounced access to the child care center during the hours of operation. The Division of Regulated Child Care representatives arrived at the center at 11:50a.m. on 05/26/2023. They were not granted entry into the center until 1:41p.m. With the exception of sixteen (16) minutes between 12:26p.m. and 12:42p.m., the DRCC representatives maintained visual awareness of all walking paths leading to and from the center's entrance. At no time were children or staff observed approaching the center. The DRCC representatives knocked on the center's entrance door, as well as the side door, multiple times during the maintained observation of the center. Upon gaining entry into the center at 1:41p.m., two (2) staff members and six (6) children were observed inside the center. One (1) child in the infant room and four (4) children in the preschool room were sound asleep upon the immediate observation of them. The staff member who allowed the DRCC representatives entry into the center contended that they left the center at 11:50a.m. and returned to the center at approximately 1:35p.m. Separate interviews with the staff members revealed contradictory information about where the staff and children went on their field trip and what they consumed for lunch while on their field trip.

On 01/29/19, at approximately 10:20 A.M., a surveyor attempted to gain entry into the center by repeatedly pounding at the door. The surveyor could observe lights on in the center, but could not observe children as the classrooms are not visible from the door. The surveyor then reported to the Regional Program Manager (RPM) that entry was not being accessed. The RPM attempted to contact the center by phone, calling both the business phone and the alternate phone, with no answer. The RPM then contacted the director who stated she was 5-10 minutes away and would arrive within minutes. The surveyor observed the director entering the building with a key. The surveyor then attempted again to gain entry by knocking, but was once again denied access. The RPM called the provider and stated the surveyor was outside the door. Interviews were conducted with the staff in charge and with the staff member in the Infant room, which is located closest to the door, and both stated they did not hear anyone pounding at the door. The staff stated her date of hire is April 2016, and she indicated her age and educational credentials. Review of employee records received from the child care center director revealed no conformational documentation for this individual caring for children on 02/15/17. The individual identified in the employee records was not the staff present on 02/15/17. On 02/22/17 interview with staff revealed the staff person present on 02/15/17 was on 02/15/17. In addition, further information was requested of the child care center director on 02/22/17, to determine the exact identity of the individual who cared for children on 02/15/17. The child care center failed to present requested documentation at the second request of the surveyor, to include employee records and timesheet information for the date of 02/15/17. Unsuccessful telephone contacts and messages were left with the child care center on 02/28/17 to obtain requested documents. On 03/08/17 identifying information was received from the director for staff with a hire date of 01/23/17, that would indicate this individual was the sole staff present on the evening of 02/15/17. An adult entered the child care center and requested two (2) children for pickup. The children appeared surprised, concerned and apprehensive about leaving with the adult. Upon review of the children’s files and interview with the adult, it was determined the adult was not an individual designated in writing by the parents to pick up the children. The staff did not review the files of the children or request identifying information from the adult until the surveyor requested review of each child’s record. On 03/03/17, the child care center director stated the staff who worked alone with five (5) children on 02/15/17 was hired on 01/23/17. Continued observation revealed that the metal object was located at the entrance to the playground and within reach of a child entering the licensed outdoor play area. Interview revealed that the procedure for leaving the outdoor play area to re-enter the building required that children would utilize an alley with no side walk that is also used by moving vehicles.
