Observation of the community classroom at approximately 1:31pm revealed the staff member who answered the door was supervising thirteen (13) children ages two-years-old to three-years-old by herself. During this time period the center was over ratio by three children. At one point there was one staff member left alone with the 21 children for approximately one minute during this time frame. Further observation of the infant classroom revealed that from 8:22 a.m. to 8:25 two staff were with 17 children ages one thru age four, exceeding minimum ratios by five children. On two separate incidents for approximately one minute two staff members were left with 17 children ages one thru age four. On two separate occasions from 8:31 a.m. to 8:32 a.m. and 8:37 a.m. to 8:38 a.m. two staff members were alone with 18 children ages one thru age four. From 8:48 a.m. to 8:50 a.m. two staff members were alone with 19 children ages one thru four, exceeding miminum ratios by six. During the incidents of the third staff member leaving the classroom, the staff member would be taking or retrieving items from the kitchen or elsewhere in the center or taking children to the restroom. Based on observation in the infant room as the children were seated and waiting for lunch to be served, there were fifteen children ages infant thru age four with two staff members from 11:15 a.m. to 11:26 a.m. At nap time twenty one children were sleeping in the infant room. Based on observation there were two staff members in the infant room with twenty one children ages infant thru age four for two minutes. To get to the outdoor playground, the children must walk next to an outdoor bar seating area. Observation of the ground where the children would be walking revealed numerous beer bottle tops, cigarette butts and broken beer bottle glass on the ground causing potential hazards for the children should they fall on the glass or bottle tops or put any of these items in their mouth. 5.) Four toddlers were observed to be sitting in their highchairs from 8:04 a.m. until 10:16 a.m. other than when they had their diapers changed. The children ate breakfast in the high chairs, waited for their peers to have their diapers changed and were provided some programming in the high chairs, however this was an excessive amount of time for toddlers to be confined to a highchair. 6.) Based on observation in the main hallway of the center, a candle was burning all day on a popcorn machine next to where the school age children put their belongings into crates attached to the wall. The candle could have been knocked over if the popcorn machine which is on wheels was bumped and burned a child with the fire or the hot wax.

Based on interview with the Training Coordinator from American Safety and Health Institute, the issuer of the CPR and First Aid Certification cards, three individuals with CPR and First Aid Certification cards presented to surveyor at the time of annual survey were found to be altered as there was not a CPR/First Aid class taught on the dates on the CPR/First Aid cards(5-13-13, 7-15-13 and 2-3-12) and the Training Coordinator stated that the cards were altered as the writing and the ink on the CPR/First Aid cards presented did not match the writing nor ink of the trainer. Further interview with the Training Coordinator revealed that one of the cards did have a CPR/First Aid class held on the date on the card(2-3-12), however, the person listed on the card was not in attendance and did not sign the attendance roster at the training. Observation on the center vehicle revealed two car seats that have a five point harness system as evidenced by the seat buckle on each seat base. Further observation revealed that there were not any straps to snap into the seat buckle as they were tied into knots behind both car seats. Based on interview with a staff member driver, the driver demonstrated that the car seats are used by pulling a shoulder belt over the car seat and buckled into the vehicle with the straps of the vehicle shoulder belt going over the top of the car seat and no other buckling system used to buckle the child in. Observation of the carseats revealed that the car seats are manufactured to have the vehicle seat belt threaded through the back of the carseat and snapped into the vehicle seat buckle and the child is to be snapped into the carseat using the five point seat belt provided by the manufactuer that was absent from both of the carseats. This lack of proper use of the car seats placed the young children using these seats at great risk of harm as they were not properly secured in the vehicle.
