General: Based on review of documentation, video footage from 09/04/25 shows a staff member on her cell phone while the children were sitting in a carpeted area and at a table, and a second staff member sitting next to the changing table. A child appeared to be hitting another child, and the staff member walked over and grabbed the child by the arm, then smacked the child’s hand very hard five (5) times. Additionally, the staff member snatched the child up by the arm at her shoulder and carried her to a crib. The staff member then put the child into the crib, saying “Bye, lay down”, while the child was crying and the second staff member remained in the same position, asking the child who was hit by the other child, “Are you alright?”. The aggressive staff member was still on her cell phone during and after the incident, discussing the behavior of the child. The child's health, safety, and comfort were jeopardized on 09/04/25 as a result of the staff member's aggression toward her. Additionally, the health, safety, and comfort of the remaining children in the room were also jeopardized due to witnessing the physical and verbal actions of the staff member. Additional video footage from 09/04/25 shows a staff member on her cell phone walking back and forth away from the changing table, while a child was lying unstrapped and unattended on the changing table. The other children were playing and watching the television while the staff member continued walking back and forth, checking on children in the bathroom and the child on the changing table. Two (2) children started wrestling each other, and another staff member in the classroom yelled, “Hey,” then the previous staff member yelled, “Stop fighting, boys, now, you two need to go to time out.” The staff member then yelled, “Go!” The staff member walked back over to the changing table, then told one (1) of the children who were wrestling to go to the bathroom while the other child was crying. The staff member yelled, “You know better.” The staff member pushed the crying child by his arm into the corner on the other side of the changing table, then grabbed his ear and put him in the corner, saying, “Do you want me to take you to the bathroom and call Nesha? Huh? Get in the corner.” The staff member walked across the room again while the child was crying, then turned around and took her shoe off and headed towards the crying child and said, “Hush or I’m gonna give you something to cry about, be quiet, you want me to call Nesha, she’s gonna come give you a whooping, hush, hush, or you not getting a snack”. The staff member put her shoe back on and walked across the room, yelling at another child, “Put the toilet seat up, all the way,” as she entered the bathroom. The whole time the incident was going on, one of the children was still on the changing table, unstrapped and unattended. The other staff member never moved from the spot where she was sitting on the other side of the changing table. The health, safety, and comfort of all children in the classroom were jeopardized on 09/04/25 due to the aggressive and threatening behavior of one (1) staff member, the non-responsive nature of the other staff member, and the lack of attentiveness to a child on a changing table. She told the child that she was going to call the someone to whoop the child if he did not stop crying. The staff member also threatened not to give the child a snack if he did not stop crying. The same staff member removed one (1) of her shoes and raised it in a threatening manner toward a child. Additionally, the same member utilized discipline associated with rest by roughly placing a child in a crib in response to the child hitting another child. The was done after the staff member firmly hit the child's hand five (5) times in response to the child's behavior.

General: Based on Interview, observation and review of documentation, it was determined the center failed to comply with regulatory requirements regarding written documentation, specifically daily attendance records. Interview revealed at least four (4) children were in attendance on 11/20/15, 11/23/15, and 11/24/15. Observation on 11/24/15, revealed four (4) children present. Review of the center's attendance records for 11/20/15, 11/23/15, and 11/24/15 revealed the center failed to document both the arrival and departure times for each of the referenced children. Exit interview with owner revealed acknowledgment of the deficiency.
