General: Based on Review of Documentation, Interview, and Observation, the child care center director failed to assure compliance with regulatory requirements, i.e. the director failed to provide for the health, safety, and comfort of a ten-year-old child on 10/28/15. Review of incident report revealed on 10/28/15 a ten-year-old child fell out of a hammock on the playground and hit her head against a log. Interviews with director, staff members, and parent were consistent with incident report. Continued interviews with director and staff members revealed the child was lying in the hammock while at least two (2) other children were pushing her, causing the hammock to be used in an inappropriate manner. Continued interviews with director and staff members revealed at least one (1) staff member observed the child being pushed in the hammock and instructed the children to stop; however, the staff member failed to take further action and ensure the children had actually stopped. Consequently, the child fell out of the hammock and hit her head on a log, sustaining a large knot on her head which required medical attention. Further interviews with director and staff members revealed the log which the child hit her head on was in close vicinity to the hammock, creating a foreseeable hazard at the time of incident. Observation of the playground on 11/30/15 revealed a few logs were still in very close vicinity to the hammock; thereby, continuing to create a foreseeable hazard. Review of documentation revealed the director presented first aid/CPR certification for one (1) of the staff members at the time of survey. Interview with director revealed the aforementioned staff member was present and on duty at the time of incident on 10/28/15; however, interviews with director and several other staff members revealed the aforementioned staff member was not the staff member who administered first aid to the ten-year-old child on 10/28/15. Interview with director revealed none of the staff members who actually administered first aid to the ten-year-old child or assisted in the administration of first aid were currently certified to administer first aid/CPR at the time of incident. Based on observation conducted on 10/13/15, a heating device used for warming bottles was located on the top of a small, black refrigerator observed in the infant room. Based on further observation, the infant room contained nine (9) children under the age of 15 months, including children who were observed walking. Based on further observation, a child was holding onto the refigerator as she walked the perimeter, where a dangling cord to the bottle warming device was hanging and was accessible to the child. Based on continued observation, in the Toddler I room, a large, thick, white cord to the air conditioner, was hanging and lying on the top of a child's stove, in a kitchen set, and accessible to the six (6) children observed. Based on interview with the staff member in the Toddler I classroom, the children were all one year old. Based on continued observation, in the Little Explorer's classroom, an electrical wax warmer, containing melted wax was observed to be on a table and accesssible to children.
