General: Based on observation of video surveillance, on 02/17/2020 at approximately 3:45pm a two-year-old child left his class which was on the playground and went inside the building through a side door that had been propped open with a block. The child went down a long hallway and into a large open entrance area of the building that leads outside to the front parking lot, cafeteria or courtyard. The child stood in the entrance area for a few seconds then went into the cafeteria and retrieved a plastic child size shopping cart and was seen again on video approximately one minute later pushing the cart around in the front entrance of the building. During the time the child was in the entrance way with the shopping cart, one adult male came out of the cafeteria, looked at the child then walked past the child down a hallway. Within a few seconds a second adult male came in through the front entrance of the building, walked past the child and straight out onto the courtyard. Approximately thirty (30) seconds later an adult female walked in through the front entrance of the building and looked at the child several times then walked over to the entrance door of the child care facility and requested to be let in. While that adult female waited to be let into the facility another adult female and adult male walked in through the front entrance of the building and both adults looked at the child and the adult male waved to the child but then they both walked past him and into the cafeteria. During that time, someone from the child care facility opened the facility door and the adult female, who was waiting to be let in, was seen talking to the staff person and looking over at the child. A second staff person then came out of the facility door carrying another child and walked over to the two-year-old child, picked him up and took him back into the facility. The child was alone without any adult supervision for approximately three minutes. Per interview with staff, there were three staff present on the playground with nine children. One staff member took in five of the children for diaper changes leaving four children still outside on the playground with the two other staff. The two staff on the playground stated they counted only three children and thought that the other staff had actually taken in six children instead of five children. General: Based on Interview, the facility failed to provide for the health, safety and comfort of each child. During a complaint investigation administrative staff acknowledged that a five (5) year old child received injuries to his face (scratches, abrasions, bruising) while in their care on 5/2/12. The two (2) staff identified as being present with the child when the injuries occured stated that they did not observe the child get hurt and indicated that they were not aware of the child being injured until the day after the incident when it was brought to their attention by administrative staff. The child told the DCBS Worker during interview that he was pushed off a piece of playground equipment by another child and got hurt when he landed in the mulch. The child also told the DCBS Worker that he told his teacher what happened. The time of the incident was identified as sometime between 2:30PM - 3:00PM on 5/2/12 and the child was present at the facility until 4:00PM on this day. General: Based on Interview, with staff during a complaint investigation it was revealed that on 5/2/12 four (4) staff went out on the playground with children in the Pre K 1 and Pre K 2 classrooms from 2:30PM - 3:00PM; however, staff indicated that there were only two (2) staff present with the children at some point during this time frame. Staff stated that a staff person from Pre K 2 escorted a child inside to use the bathroom during this time frame and a staff person from Pre K 1 went inside the building for an unknown reason at the same time. A review of the facility attendance records found that thirty-two (32) children (four (4) and five (5) year olds) were present on the playground during this time frame. The facility exceeded the staff/child ratio by four (4) children and the group size by four (4) children, during the time frame that there was only two (2) staff present with the children. However, the facility exceeded the group size by four (4) children during the entire time frame (2:30PM - 3:00PM).
