General: Based on observation, at approximately 1:30pm, the surveyor and two additional cabinet representatives went to the front door of the facility and rang the doorbell. After waiting approximately 2 minutes, the surveyor knocked on the door and also rang the doorbell for a second time. The surveyor could see into the building and saw a child standing in the doorway of a nearby classroom. There was a teacher standing to the side of the classroom door. At 1:36pm, the surveyor called the facility and could hear the phone ringing from outside but no one answered the phone. At this point, one of the other cabinet representatives called the cell phone number of the facility's contact person and explained that no one would come to the door or answer the phone. The staff person stated that he would call the facility and get someone to come to the door. After waiting approximately ten (10) minutes, a staff person came and unlocked the front door. This person directed the surveyor and the DCBS staff to wait by the front door until the staff person in charge arrived. The surveyor clarified that a walk through of the facility would be conducted at that time. It is important to note that a staff person was observed in the kitchen area. At 8:13:45 she left the room and came back at 8:14:03. At 8:17:16 the staff left the room, some children sat in the doorway, and some children continued to play in the room. The staff was still out of the room at 8:19:11 when the video jumps to 8:23. She was still out of the room at that time and could be seen in the hall area sweeping the floor while children are in the classroom. At 8:24:53 another staff person began to pull babies in high chairs into the room. She brought in one (1) then left to get another and then left again to bring in a third baby. The staff person stated that after she tugged him into the room he said he had a boo boo on his back. There was conflicting information as to whether the injury on his back was there before she dragged him on the floor or if that was the cause of the injury. The staff person first wrote an incident report saying that in process of dragging the child his back sustained a rug burn. The staff person later typed a statement that said the injury was there before she dragged him. After she dragged him and the child told her about the boo boo she took an old band aid off to look at the injury then put a new band aid on. The staff person stated that the discrepencey in the two (2) reports was because she wrote the first in a hurry and had more time to complete the second. The video of this incident was viewed by the Crimes Against Children detective. He reported to the DCBS worker that the video showed the staff person drag the child approximately three (3) to four (4) feet. Also, found through interview was an incident of a staff person restraining a child. The staff person stated the child pulled a student’s hair, hit her on the head, and “mean mugged” her like he was going to hurt her again. The staff person said that she took the child's wrists and held his arms behind his back because he was fighting her. The staff person said that the child kept moving around while she held him this way and went to the ground. She said that he did this himself but tried to make it look like she did it. She stated that she looked at the child and he had no injuries as a result of her restraining him. Based on review of video from what appeared to be 11/9/16 there were two (2) instances where a staff person picked up children by one (1) arm and lowered them to the floor.
