In the video, the child can be seen walking back and forth in the classroom with the taped shoes, while the staff member took a photo with her phone, as confirmed in her interview. The photo was sent to other staff members via a group message. It should be noted that another staff member was present in the room and did not alert management when the event occurred. On 02/03/25, a staff member in the Junior Tots alerted administrators that a staff member working in the classroom had inappropriately handled a two-year-old child. A review of the footage from the classroom revealed that a staff member was sitting on the floor with a child on her lap when a second child hit her on the brow with a textured block. The staff member grabbed the child, who had hit her, by his shoulders and yanked him onto the floor, causing the child to hit his head on the toys surrounding them.

The ages of this classroom range from three to four (3-4) years old, which makes the ratio one (1) teacher to fourteen (14) children, meaning that after the first staff left the room, the remaining staff was out of ratio by one (1) child. The child sustained fingernail marks on her arm and her arm was bleeding. General: Based on review of video footage from 06/08/23, and 06/12/23, in the one-year-old classroom, the following was found: 1) Children were viewed sitting, standing, jumping, and lying on top of the child size tables in the classroom while staff were using their phones; in many instances staff just sat in chairs across the room and casually watched the children. 2) Two (2) children were smacking/fighting with one another while a staff member watched. The staff member said something to one (1) of the children and then pushed that child towards the other child he was fighting as if encouraging it. The child swung at the other child and one (1) of them fell down. The staff member stood the child back up and pushed the child towards the other child again. The staff member kept doing this until one (1) of the children ran off. At no point did the staff member try and stop the fighting. 3) Children were viewed multiple times hitting, biting, smacking, kicking, and pushing one another while staff did nothing about it. 4) A child was seen hanging from the sink by her fingers and she fell backwards, landing on her bottom on the linoleum floor. A staff member just laughed and did nothing to assist the child. This happened more than once. 7) A staff member took off her shoe (she was not wearing socks) and touched a child's face with her foot. 8) After changing a child's diaper, the staff member initially picked up the child under each arm; as the staff member was placing him on the floor, she had only one (1) hand around the child's elbow by the time his feet hit the ground. The child cried, ran over to the other staff member, and pointed to his arm. The staff member was using her phone and did nothing to assist the child. 9) The heater placed on the floor was plugged into an outlet that was located high on the wall. Two (2) children were seen running around the heater and under the cord while one (1) staff was using her phone and the other staff was out of the classroom. 10) Two (2) children were wrestling on the floor. A staff member walked up to the child that was on top of the other child, grabbed the child's shirt with one (1) hand, grabbed the child's pants with the other hand, lifted the child off the other child, and placed the child on her stomach on the floor. 11) A staff member picked up a baby doll, aggressively threw the doll against the wall, and then appeared to say something to the children. Some of the children were later observed throwing dolls and toys against the wall. 12) A staff member was viewed pulling a child up from the floor by the collar of his shirt. 13) A staff member walked over near the classroom door and lifted a child up by the left arm, causing him to fall. 14) A staff member took a child by the arm and pushed her towards the other staff member who was vacuuming. The child appeared to be scared of the vacuum, but the staff member held the child’s hand. The other staff member hit the child’s feet with the vacuum while the child was trying to get away. Then the staff member started chasing the child around the room with the vacuum. Both staff were laughing, and the child was crying. When the staff member finished vacuuming, she grabbed the child by the hand and made her walk with her out of the classroom while the staff pushed the vacuum. he child seemed to be very hesitant to go with the staff member. 15) A staff member called for a child to come over to where she was sitting. The staff member turned the child around, so his back was to her stomach. While the child was standing, the staff member wrapped her legs around the child's legs, held his hands by the wrists above his head with one (1) of her hands, and took her fist and tapped it on the child's belly. The staff member then took both of the child's arms and crossed them behind his head, holding them there. This went on for approximately one (1) minute. 16) On more than one (1) occasion, a staff person motioned as if she were going to hit a child with her hand but then did not. 17) A staff member was seated on the floor asked a child to come over to her. When the child was approximately two (2) feet away from her, she yanked the child by the front of her shirt and pulled her to the ground in order to put the child’s shoes on her feet. 18) While a staff member was vacuuming, she appeared to deliberately bump into a child more than once, causing the child to fall over onto her hands and bump her face on the front of the vacuum. 19) A child was lying on the floor and a staff member seated in a chair looked over at the child and kicked the child on the leg with her foot. 20) A staff member walked over and flicked a child on top of her head with her fingers for no apparent reason. 21) A child kicked a ball towards a staff member. The staff member picked up the ball and threw it at the child, hitting the child on the front of her body. 22) A child was lying on a pillow when a staff member jerked the pillow out from under her, causing her to topple over onto the ground. 23) A staff member appeared to say something to a child and then walked up to her and kicked the child in the butt/backside with her foot. 24) A child was teetering around after just getting up from nap. This is the same child who fell, hitting his head against the wall. 28) A staff member was sitting on the floor when a child ran up to the staff member. The staff member shoved the child away with her hand. 29) A staff member walked over to a child and pushed the child on the bottom with her shoe, causing the child to stumble. 30) A parent was seen picking up a child for the day. A staff member was hugging and kissing on another child in front of the parent. As soon as the parent left, the staff member smacked the child on the bottom with her hand. 31) A staff member and a child appeared to be arguing. The staff member and the child were both saying something, waving their arms, and shaking their heads. 32) A staff member walked over to a child, stood over him, and then flicked/pinched him on his ear. The child grabbed his ear. 33) A staff member pushed a child’s head to the ground more than once while they were both seated on the floor. 34) A child walked past a staff member seated in a chair. The staff member flicked her finger to the side of the child’s head and then threw a block at her twice. The staff member then pointed a finger at her and appeared to say something to her before throwing a block at her again. 35) A staff member was viewed combing multiple children's hair with the same comb. 36) The children were allowed to leave their shoes off all day and run around in their socks/bare feet. Children were seen walking around holding their shoes, putting the shoes in their mouths, and even hitting children with the shoes. Children's shoes should remain on at all times in case there is an evacuation of the building. 37) A staff member was seen sitting on top of one of the child size tables with her legs crossed and shoes touching the table. The child grabbed both of the staff's arms with her hands. The staff tried to get her arms free from the child's grasp, causing the child to fall down. The child got up; the staff member swatted the child on the bottom with her open hand and then appeared to tickle the child. 45) A staff member was seen taking a child's shoe and hitting the child on the leg with the shoe. 46) Staff are viewed multiple times throwing foam blocks at the children, often hitting them on the head, back, or other parts of their bodies. 47) A staff member seated in a chair leaned over and flicked a child on the head with her fingers. The child was just sitting on the floor. The same staff then picked up a ball and threw it towards the child she had just flicked but missed the child; instead, it hit another child on the shoulder. 48) A staff member stood up and threw a foam block, hitting a child on the head. The staff member then motioned for the child to come over to her. The staff member placed her hands on the child's hips, lifted the child up, flipped the child completely over, and the the child landed on the staff's shoulders. The child's bottom was resting on the staff's shoulders with his torso and legs straight out. The child started to squirm. The staff member kept the child in this position for approximately thirteen (13) seconds. 49) Two (2) children were standing with their hands on the ground, heads down, and bottoms up in the air. A staff member came up to the first child, took her foot between the child's legs, and flipped the child completely over causing the child to land on her back. The staff member walked over to the second child and did the same exact thing. The staff member then sat down in a chair, stuck her foot out, and flipped the first child over again the same exact way. Both children appeared stunned. 50) A staff member was on the floor with a child to put on the child’s shoes. The staff member jerked the child by the ankles to get the child closer to the staff member. The staff member then pulled the child up by the elbow and pushed the child away. 51) A staff member was sitting on the floor and a child was approximately two (2) feet away from her when the child began to turn to walk away. The staff member grabbed the child by the shirt aggressively, pulled her to the ground, looked the child straight in the face, and said something to her. 52) A child picked up a toy and a staff member jerked it out of her hand. 53) A staff member was seated with a child standing at her legs facing the staff member. The child got up and appeared to be crying, holding his head. One (1) staff was cleaning out the highchairs across the room from where the child fell and the other staff was not in the classroom. There was one (1) staff present with nine (9) one-year-old children when the incident occurred. 3) Five (5) children can be seen coming into the classroom alone and the staff member can barely be seen at the edge of the classroom door. Then the staff member completely went out of view and the children were left alone in the classroom for approximately one (1) minute. 4) Several children were playing behind the changing table where the plastic cots are stored. They were lifting the edge of a cot up and down and one of the children ended up smashing a finger. Both staff were seated across the other side of the room not supervising the children at all. The child that got his hand smashed ran up to one (1) of the staff members crying and holding his hand. The staff member said something and just laughed. 5) A staff member exited the classroom at 9:13:17, leaving the class out of ratio. Then the second staff person left the classroom at 9:15:19, leaving the classroom without any adult supervision. One (1) staff returned at 9:16:05, and the second staff person returned at 9:16:25. The staff member grabbed the child's hand, swatted it away, again grabbed the child's hand, placed it on the seat of the chair, and then sat on the child's hand. The staff member sat on the child's hand for approximately three (3) seconds and then laughed at the child. 6) A child was walking around with a plastic bin on top of his head. A staff member snatched the bin off the child's head and smacked him on the head with her hand. 7) A child took another child's sippy cup. A staff member gave the cup back to the other child and then kicked the child on the bottom with her foot. 8) A staff member flicked a child on the ear for spilling his drink and the child grabbed his ear. The staff member then came back again, flicked the child's ear a second time, and then hit him on the back of the head. 9) A child walked up to a staff member and appeared to hit the staff member on the leg with her hand. The staff member was changing a diaper, so she reached out with her foot and kicked the child. The staff member then poked the child on the face three (3) times with her finger, causing the child's head to go backwards each time. The same child then climbed on top of a play kitchen and the staff member smacked the child's forehead with her hand. 10) A child reached for a Ziplock bag that was on the floor during an art project and a staff member used her hand to smack the child on top of his hand. 11) A staff member smacked a child twice on the head with her hand for spilling the liquid out of his sippy cup onto the table. 12) A staff member was using her phone and looked up to see a child take another child's sippy cup. The staff member walked over and pushed the child with her foot. 13) A child had scooted a pen that was on top of a shelf. A staff member saw this and smacked him on the back of the head with her hand. 14) A child pushed another child; a staff member pushed the child in the chest and knocked him down. The child got up and walked over to the staff member. The staff member gave the child a hug. 15) A staff member saw two (2) children on top of the cots, so she walked over to them and smacked them on top of the head with her hand. 16) Two (2) children were standing on top of a table. A staff member took a new roll of paper towels and hit one (1) child on top of the head with the paper towels, flicked him on the ear, and then took the paper towels and smacked the other child on the face causing him to fall down. 17) A child was standing next to a staff member who was seated in a chair; the child wiped his nose with his hand and then wiped his hand on the staff's pant leg. The staff member initially grabbed the child's arm and then let go of his arm; the staff member then grabbed the child's shirt and wiped the substance off of her leg with the child's shirt. 18) A child was standing on the step at the sink; a staff member got the child down and smacked him on the bottom with her hand. 19) A child finished lunch, got up from the table, picked his chair up, and began to walk away with the chair. A staff member immediately jerked him all the way around by the arm, grabbed the chair, and forcefully placed him on the chair at the table. 20) Two (2) children knocked over the play kitchen and it landed on top of another child. The staff member walked over and used her hand to spank one (1) of the children twice on the upper part of her leg/bottom area. 21) A child was seen turning his sippy cup upside down and spilling the contents. A staff member was using her phone but looked up, walked over to the child, and popped him in the head with her hand. This is the same child who had fallen earlier and hit his head on the wall. 22) A child was placed in a highchair with nothing to do for six (6) minutes. It could not be determined what the child did prior to this discipline. 23) A staff member walked over to a child who was playing with the adult vacuum and flicked the child on the ear with her fingers. The child slumped down to the floor and appeared to be crying. 24) A child sneezed while standing directly in front of a staff member who was seated on a chair. The staff member was visibly angry, jerked the child around by the upper part of his arm, and moved him away from her. 25) A staff member grabbed one (1) of the children for hitting, took the child over to the carpeted area, placed the child on his stomach, pushed the child’s torso down with her hand, and then pushed the child’s head onto the carpet with her hand. 26) Two (2) children kept hitting another child and the staff just watched. Finally, one (1) of the staff members got up and chased after the two (2) children. The staff member got one (1) of them behind the changing table, leaned down over the child (completely out of camera view), and did something to the child; when the child came out from behind the table, he was crying and visibly upset. The staff member then did the same to the other child. One (1) of the children ran over to the other staff member, crying and showing the staff member his hand, but the staff member did nothing. 27) A staff member flicked a child’s ear for flipping up the edge of the rug. The staff member then flicked another child’s ear and that child appeared to have done nothing. 28) A staff member randomly walked up to a child, flicked him on the ear and smacked him on the back. The child grabbed his ear and then appeared to try and flick another child on the ear. A staff member saw this and made him sit in time out. 29) At 8:59:52, a child was in a highchair for an unknown reason. The child was let out of the highchair at 9:22:17. The child had nothing to play with and no activity was provided during that time. The child was in the highchair for approximately twenty-three (23) minutes. This was the second time this child had been placed in the highchair. 30) A staff member was using the facility's iPad and the other staff member had left the classroom while two (2) children were fighting over the tray that went to a highchair. One (1) child appeared to bite the hand of the other child who then appeared to cry out. The staff member stood up, walked over to the biter, stood directly in front of him (blocking him completely from the camera), leaned over him, and did something to him more than once. When she was finished, she moved out of the way and the child was very upset and crying. 31) Right before nap time, two (2) children were playing with the sheets that were on their cots. A staff member walked over to them and one (1) of the children automatically put his hand to the side of his head as if protecting his ears, but the staff member still flicked both children on the ear. The staff member walked away, and children resumed playing with their sheets. The staff member came back over and flicked them on the ear/head area again. They grabbed their ears afterwards. The staff member then aggressively grabbed one (1) of the children’s legs and flipped the child over while he was seated on his cot; she then did the same thing to the other child. The staff member then threw the children's bedding over them and smacked both children on top of the head. The same staff member then walked over to another child and aggressively put that child down on her stomach on her cot; the other staff member threw a large square pillow at the child’s head. Then a staff member walked by a child who was seated up on her knees and she flicked the child on the ear. The child immediately lay down on her cot. The staff member then picked up a foam block and threw it at the child but missed her. The staff member picked up the block again and threw it close range and hit the child on the face. The child grabbed her face; the staff member grabbed the block again and hit the child on the back of the head with the block. 34) Two (2) children were seen trying to climb a bookshelf while both staff are using their phones. While seated, one (1) staff member looked up and threw two (2) blocks across the room in the children's direction trying to get them down. 35) Two (2) children were wrestling with a toy; a staff member grabbed one (1) of the children and stood in front of him (could not see the child on video), looked around as if to see if anyone were looking, and did something to the child. The staff member took the child by the hand and sat him on the floor next to a bookshelf. The child was crying and grabbed his lower back. 36) A child was placed back in the highchair again for possibly biting another child. He was in the highchair for approximately eight (8) minutes. The staff member handed him a dinosaur to hold. After they reached the playground, a third staff member brought the three-year-old child outside and told the staff that she had found him alone in the gym. The surveyor observed eight (8) children present in the Jr. Tots Classroom during the visit. A review of the building diagram obtained during the 1/11/18 change of location inspection found that the classroom was over capacity because seven (7) was noted as being the room capacity. It is important to note that this same diagram was posted in all the classrooms throughout the facility. The staff person in charge stated during interview that she was told that the Jr. Tots Classroom was large enough for eight (8) children and she presented the surveyor with a copy of a Fire Marshal inspection dated 10/23/17. A review of the Fire Marshal inspection revealed that the Jr. Tots Room was listed as a total capacity of eight (8). The surveyor measured the classroom during the visit and found it to be 13' 8" by 20'2" which only provides the minimum thirty-five (35) square feet of space for seven (7) children. General: Based on Observation, the facility failed to ensure eating and drinking utensils be kept clean and sanitary. At the time of survey, two (2) sippy cups and three (3) spoons were observed in a single compartment sink in the infant classroom. The staff member in the classroom reported that they wash the dishes used by the children in the single compartment sink. The staff member also reported that the sink is sometimes shared as a hand washing sink and is not sanitized in between uses. The staff member reported that the dishes used by children enrolled in the facility are washed with soap and water, but are not sanitized.

General: Based on Review of Documentation, and interview it was found that the facility employed a person that was found by the cabinet to have neglected a child, pursuant to 922 KAR 1:470. Following the Division of Regulated Child Care's receipt of a child abuse and neglect check submitted by this facility for an employee a phone interview was conducted with the director. During this interview it was confirmed that this individual was employed by the facility. The director also confirmed that she had a copy of the child abuse and neglect check that identified the substantiation but had not realized there was a substantiated finding marked on the report. The director indicated that the individual listed on the child abuse and neglect check was hired in February but only worked a couple of days due to a family emergency. During the brief time the person worked she was under the supervision of another qualified teacher. The director went on to indicate that the individual had also worked on April 29, 2013 and May 3, 2013.
