At approximately 10:30 am, one (1) staff member began leading circle time while the other worked to redirect children back to the activity as needed. By approximately 10:50 am, the children were still seated in circle time. The surveyor noted that the activity had continued for an extended period. Next, the staff member in charge entered the classroom to inform the staff that the activity had gone on too long. In short, the children were required to sit for a prolonged period.

General: Based on observation and interview, the following was found: Classroom #8 The surveyor entered the classroom at 10:02 am and observed twenty-three (23) children ages three (3) to-four (4)-years-old and two (2) staff members. One (1) staff member was sweeping the floor, and the second staff member was getting a child’s jacket. The children were lined up at the door preparing to go outside. At 10:07 am, the children were still lined up at the door while the staff member was still sweeping the floor. The staff member stated that the children had only been lined up for a few seconds and that she was trying to teach them the “kindergarten line”. At this point, some of the children were getting out of line and going to centers. The surveyor noted that one (1) female child was walking around drinking from a water bottle. The second staff member went to the dramatic play area to coax the children back in line. At 10:11 am, the children were told to “catch a bubble” and to stay in line. At 10:12, the surveyor noted that there nine (9) children out of line. At 10:12 am, the staff member tells the children to get out of line and sit on the edge of the carpeted area on the black line. This staff member picked up the child and stood him up on the changing table to pull up his pants. She then leaned towards the trash can to throw away her gloves and that is when the child fell off the changing table onto the floor. The changing table was 34” in height. The visible injury according to the staff member was a busted lower lip and redness on the child's chest. The child fell on his chest, then hit his head on the floor.

General: Based on interview and review of documentation, this regulatory requirement was not met. On 08/06/23, an eleven-year-old child was playing basketball in the outdoor play area with a friend. The basketball got away from the child and went towards a staff member's head. The staff member was angry and yelled at the child, “I am tired of you being so rough with this ball”. The child responded asking why the staff member was yelling at him. The staff member responded by yelling in the child's face, “I am an adult”. The staff further stated to the child, “Your momma oughta knock the teeth out of your face." She continued to say, "If I was your momma, I'd slap the glasses off your face.” The staff member was terminated from employment after this incident. General: Based on observation and interview, the child-care center failed to meet this regulation. The surveyor entered classroom #1 at approximately 9:09 a.m. and observed a male infant in a car seat located in an enclosed gated area. The surveyor noted the infant was buckled in the car seat and was asleep. Staff interview found the seven-week-old infant had arrived at 7:06 a.m. and had been asleep the entire time. Staff person #1 stated that the infant’s parents had requested they not remove him from his car seat if he was asleep. The surveyor noted the infant had been in the car seat for two hours. It is important to note the infant was asleep on his back; however, there was not a waiver on file from a health care professional allowing staff to leave the infant confined to a car seat for sleeping purposes. At approximately 9:30 a.m., the surveyor noted staff had removed the infant from his car seat.

At approximately 9:52 a.m., the surveyor noted two children still standing in their cribs. At approximately 10:08 a.m., the surveyor noted one child still standing in a crib. General: Based on observation and interview, the child-care center failed to have enough toys and materials to provide children with a variety of activities as follows; 1. The surveyor found no blocks that children could independently stack available to the children in care in classroom #1, classroom #2, and classroom #6. Additionally, the surveyor found only five blocks available to a group of seven children in classroom #5. 2. The surveyor found no multi-cultural materials represented in the classroom environment or available to the children in care in classroom #1 and classroom #6. 3. The surveyor found no musical instruments or music activities implemented in the daily routine in classroom #6. It is important to note the surveyor found the child-care center utilizes the Creative Curriculum in the infant, toddler, and preschool classrooms. The surveyor found several shelving units bare in the classrooms with the exception of classrooms #7 and #8. Staff indicated that they do not have enough materials and equipment to add to their classroom environments in order to implement the curriculum. For example, the surveyor found the lesson plan posted on the wall outside of classroom #2 had “Circus” as the theme and circus activities listed on the plan. The surveyor did not find any circus themed materials in the classroom. Furthermore, when the surveyor asked if the staff had the materials to do the balloon painting activity listed on the lesson plan, the staff person could not locate any of the materials. Additionally, the lesson plan posted in classroom #5 had “Tubes/Tunnels” as the theme and activities pertaining to tubes and tunnels listed on the plan. Yet, the surveyor did not find any materials or equipment in the classroom to implement the plan. The staff person indicated that she has to share materials with classroom #6. The surveyor only found only a few cardboard tubes that children had painted in classroom #6. The staff person in classroom #6 stated that she does not share materials. General: Based on observation and interview, on 09/24/19, a one-year-old child was placed in a highchair by the child's mother to eat breakfast in the Infant 2 classroom. The safety straps were not secured around the child after placing him in the highchair. A staff member stated that after he was finished with breakfast several minutes later, she went to remove the child from the highchair without knowing the child had not been secured. The staff member stated that she removed the tray and turned to place the tray down when the child fell forward out of the high chair and landed on the linoleum floor. The staff member stated that she checked the child over and found no marks or bruises. The staff person in charge notified the child's parents. The staff person in charge stated that the child was not taken to a doctor or hospital for an examination. It should be noted that the same type of incident in the same classroom occurred on 06/13/19, to an eleven-month-old child.
