General: Based on interviews and review of documentation, the child care center director failed to assure compliance with regulatory requirements. Staff interviews revealed that a child consistently displays inappropriate behavior on a daily basis. The behaviors were described as kicking, screaming, biting, hitting, and hair pulling which occur every day. Further interview revealed that a plan to alter the behavior by staff and or parents has not been discussed or developed. Written documentation revealed that 15 accident reports were submitted for the aforementioned child's behavior within nine (9) months, from 07/23/18 through 04/16/19. Interview with staff revealed incident reports are not completed for the incidents that occur on a daily basis, when the child "throws fits", because the staff do not have time to write all of the incidents up. The child is allowed to "throw a fit" and then rejoin the class after she is finished. Continued interview revealed the staff member was holding a child's hand to prevent her from hitting her head on a bookshelf or floor, resulting in a broken bone. Interviews also revealed the child hits another child every day, with no prevention plan to protect the other child and all of the other children in the room who she is biting, hitting or pulling their hair. Interview with the parent revealed she was unaware the behaviors were occurring on a daily basis, and would have been addressing the issue at home had she been aware. Further interview revealed the parent was not told because the staff in charge does not like to send problems home.

However, review of the staff member's TB certificate presented for review on 6/22/16 revealed inconsistent information; the date the test was given was 8/16/14 and the date the test was read was 8/18/14, the three (3) appeared to be altered to an eight (8).
