General: Based on observation, the surveyor found the following: 1. The surveyor conducted a walkthrough of the child-care center starting at 11:23 am, conducting a headcount of each classroom. The surveyor entered the School Age Classroom at 11:30:40 am and observed two (2) children alone from 11:30:40 am until 11:31:32 am. The surveyor observed a staff person walk from the kitchen into the School Age Classroom at 11:31:42 am. The children in the School Age Classroom were observed to be playing in the School Age Classroom unsupervised until the staff person entered the classroom. Through documentation review, the surveyor found that the children were three-years-old and four-years-old. 2. The surveyor observed a staff person exit the School Age Classroom at 11:32:10 am enter the Kitchen while on her cellphone and leave the two (2) children in the School Age children unsupervised. Through documentation review, the surveyor found that the children were three-years-old and four-years-old. At 11:32:11 am, the surveyor observed another four-year-old child enter the School Age Classroom from the Preschool Classroom. The surveyor observed the three (3) children to begin putting paper plates on the tables. The surveyor observed the staff person enter the School Age Classroom at 11:32:52 am from the kitchen. 3. At 11:33:20 am, the surveyor observed a three-year-old child leave the Preschool Classroom and walk through the School Age Classroom to go into the restroom alone. At this time, the three-year-old child was out of vision of all staff and did not have shoes on to enter the restroom. The surveyor observed that the gate to the kitchen was left open. The surveyor observed the three-year-old child reenter the Preschool Classroom at 11:34:10 am. 4. At 11:37:31 am, the surveyor observed a staff person leave the School Age Classroom and reenter the Kitchen. During this time, a three-year-old child and four-year-old child were in the School Age Classroom unsupervised. The surveyor observed the four-year-old child climbing on a table and the three-year-old child was doing flips. The surveyor also observed the four-year-old child climb on totes that were stacked beside a shelf. The surveyor observed the three-year-old child run down the hallway toward the Nursery two (2) separate times. The surveyor also observed both children to play tag. At 11:42:37 am, the surveyor observed the four-year-old child go into the restroom unsupervised, where she was out of vision and out of range of voice. The surveyor observed the four-year-old child exit the restroom at 11:43:29 am and then reenter the restroom at 11:34:40 am. The surveyor observed the four-year-old child exit the restroom at 11:44:28. The surveyor observed the staff (DOH: 09/29/23) reenter the School Age Classroom at 11:45:23 am. 5. At 11:44:44 am, the surveyor observed a three-year-old child enter the restroom unsupervised and was out of vision and out of range of voice. The surveyor observed the child exit the restroom at 11:46:00 am. The surveyor observed the School Age Classroom to be unsupervised from 11:30:40 am – 11:31:32 am, 11:32:10 am – 11:32:52 am and 11:37:31 am – 11:45:23 am. During the time the surveyor was standing in the School Age Classroom, the surveyor observed a staff in the Preschool Classroom attending to the children in the Preschool Classroom. Through interview with staff, the surveyor learned that a staff person alerted staff-in-charge that she could not find the three-year-old child. Through interview with staff, the surveyor learned that staff at the child-care center last saw the three-year-old child inside the child-care center between the approximate times of 2:50 p.m. – 3:20 p.m. and he had exited the child-care center alone by unlocking and opening the kitchen door located by the restroom in the School Age/Lunchroom Area. The surveyor also learned that the three-year-old child entered the kitchen, opened the back door to the child-care center, and went outside. The surveyor observed the back of the child-care center backed up to a hillside and a concrete walkway was observed going down the length of the building where the center is located, which is beside Walmart. The surveyor observed a busy parking lot located in front of the child-care center and Walmart. Through interview, the surveyor learned that video footage was obtained from Walmart by law enforcement that showed the three-year-old child coming from around the back of the child-care center building. The child can be seen on the video footage walking halfway up an alley located between the mountainside and Walmart. Through interview, the surveyor learned that the three-year-old child can be seen climbing up onto a guardrail in this area and looking over it, roaming around, and running around in circles. The surveyor learned through interviews that the three-year-old child can then be seen making his way back down to the corner of Walmart to the sidewalk and then the child goes out of camera range. Through interview, the surveyor learned that witnesses helped to get the three-year-old child inside Walmart and law enforcement was called. The video footage did not show the three-year-old child going into Walmart and did not show anyone coming out the front door of the child-care center while the three-year-old child was unattended. A written statement was provided by the Department for Community Based Services (DCBS) that outlined the times from the Walmart Cameras as follows: 15:22 – Child comes from behind building; 15:27 - Law Enforcement called; 15:32 – Law Enforcement arrived; 15:34 – Law Enforcement spoke to the facility; and 15:39 – The mother of the three-year-old child arrived. The surveyor walked the distance from the back door of the child-care center to the front door of Walmart and measured the distance as 220 steps. Therefore, the child-care center failed to assure that the three-year-old child was provided adequate supervision by a qualified staff person and was within scope of vision and range of voice at all times. General: Based on interview, the surveyor learned that the Three-Five-Year-Old Classroom consisted of twelve (12) children and one (1) staff person on 04/05/23. Staff provided the surveyor with a handwritten list that contained the twelve (12) children's names who were inside the classroom on 04/05/23. During the investigation, a staff person pulled the twelve (12) children's files for surveyor review which indicated that two (2) of the twelve (12) children were only two (2) years old; therefore, the classroom exceeded the staff-to-child ratio by two (2) children. According to interview with staff, the surveyor learned that two (2) staff persons were in the classroom from approximately 9:00 a.m. to 9:30 a.m. on 04/05/23. Staff reported that one (1) of the staff persons came out of the classroom to start lunch. The surveyor found through a review of attendance records that the last two (2) children were signed in at 9:00 a.m., making the group size twelve (12). The attendance records verified one (1) child was signed out at 3:56 p.m. and one (1) child was signed out at 4:12 p.m.; therefore, the group size was ten (10) at 4:12 p.m., putting the classroom back within ratio. During interview, staff-in-charge stated that she was aware there were two (2) two-year-old children in the room. Upon interview, staff reported that they alternated preparing lunch in the kitchen leaving only one (1) them in the dining area to supervise the ten (10) children. A staff file (DOH: 3/10/14) presented for review did not contain a copy of the original criminal record background check that was completed on 3/10/14 per the previous renewal inspection completed on 5/18/17 for the center's other location. The staff file only contained a criminal record background check for 3/7/17. Staff reported that that original criminal record background check might be located at the other center or could have been lost while the file was being transported between the centers.
