General: Based on observation, upon arrival at the center, two (2) staff members were observed in the hallway. One (1) staff member was holding a child from Classroom 111, while the second staff member approached and spoke with another child from the same classroom. The first staff member then contacted the person in charge to notify her of the surveyor’s arrival. After a brief conversation, both children were returned to the classroom and the door was closed. The children began crying, and both staff members returned to their assigned classrooms, with one staff member entering Classroom 114 and the other entering Classroom 116. This interaction lasted approximately three (3) minutes, from 2:35 p.m. to 2:38 p.m. During the subsequent classroom walkthrough, the surveyor observed fifteen (15) three-year-old children present in Classroom 114, indicating the classroom would have been out of ratio while the staff member was in the hallway with a child. It could not be determined how long the staff member had been out of the classroom prior to the surveyor’s arrival.

A review of the individual’s personnel file revealed that she had not completed a fingerprint-based background check through the Kentucky National Background Check System (KARES). The staff member in charge stated that she believed a background check was not required because the individual had volunteered and was never left alone with children. She further indicated that once the individual was hired, she did not consider it a regulatory violation as long as the individual was not unsupervised. The individual confirmed that she was not left alone with children while volunteering in the after-school program; however, she acknowledged that while working in the toddler-preschool program, she was occasionally alone with children when other staff members took restroom breaks. When the surveyor inquired whether it was typical practice for children to go to the restroom unaccompanied, the staff member confirmed, stating, “Yes, they just have to tell us where they are going.” The three (3) children were gone unsupervised for three (3) to five (5) minutes. The surveyor then exited the gym and located the restrooms, which are situated between the gym and the cafeteria.
