General: Based on observation and interview, the child care center failed to maintain state regulations. At approximately 10:31am, a loud voice was heard by the surveyor while sitting in the foyer entering file data. The staff member was yelling "hush" and "sit down now!" The staff in charge, who was sitting next to the surveyor, immediately got up and went into the Two's Room, which was directly beside the foyer to the left. Upon returning, the staff-in-charge told the surveyor she talked to the staff, and advised her to not yell at the children--particularly one individual student whom she claimed was being disruptive. Next, at approximately 10:51am, the same voice could be heard yelling loudly "what do you think you're doing?" This prompted the surveyor to tell the staff in charge that she needed to handle the situation immediately. The staff in charge subsequently entered the Two's Room and called another teacher, who was acting as a floater in the facility, to give the Two's Room teacher a break. During the exit conference, the surveyor explained the regulations in regards to discipline and she acknowledged the situation as being problematic.

The children were required to sit and wait outside of the bathroom as each child's diaper was changed. Some of the children got up, went into the bathroom and started getting into the supply of diapers located beside the changing table. Some of the children were crying. The children were required to wait with no activity as each child was diapered. At 10:43 a.m. the staff in this same room started putting children in high chairs and seating them at the table to prepare for lunch. The surveyor observed the posted daily schedule for the classrooms and noted that lunch is served at 11:00 a.m. At 10:46 a.m. the children were still waiting for lunch to arrive. Some of the children were crying and those who were sitting at the table started getting up but were quickly reprimanded by staff and told to sit back down at the table. One (1) child sitting in a high chair was observed falling asleep. At 10:50 a.m. the children were still seated and waiting for lunch. At 10:51 a.m. children in the 2's room were seated at the table to prepare for lunch. At 10:55 a.m. the children in both classrooms were still seated and waiting for lunch to be served. Staff in the 1's room continued to tell children to sit down. At 11:00 a.m. lunch was served.

General: Based on observation, the following was found: 1) In the handicap accessible women's bathroom located across from the Three to Four (3-4) year old room, a spray can of Fabreeze air freshener was observed on top of a low, gray storage chest. The label on the can had a warning to keep out of the reach of children. An interview with the staff person in charge found that this bathroom is used for staff only. It should be noted that the door to the bathroom was open at the time and the spary was low enough for a child to reach. 2) A storage room located beside a men's bathroom was also observed in this area. The door to the storage room was open. Indside the door on a low shelf was a bottle of Pine Oil cleaner. On another low shelf located near the door was a can of Comet cleanser, containers of Kroger brand disinfectant wipes and two (2) spray bottles of Home Sense brand multi-purpose cleaner. The labels on all of these containers have a warning to keep out of the reach of children. It should be noted that the storage room is located beside the bathroom used by the children. The children were sent out into the hall with the other children who were waiting without having their hands washed. The other staff person who was in the hallway waited a few minutes and then took the three (3) children back into the bathroom and helped them wash their hands. In addition, once this group of children had their diapers changed and hands washed they were taken back to the classroom. The children were observed playing with toys. Staff then put four (4) children in highchairs to wait for lunch and the remaining children were seated at the table to wait for lunch. This occured at 10:43 a.m. and lunch was not served until 11:00 a.m. The children's hands were not washed again after playing with toys prior to eating lunch.

The instructions noted by the parent were to administer the medication every four (4) hours. A specific time was not noted. It was documented that the medication was administered at 8:38 a.m. on 1/30/19 and at 4:00 p.m. on 2/1/19. 2) It was found that on 2/11/19, a parent requested that a breathing treatment be administered every four (4) hours then and the time of 2:15 p.m. noted. There was no record that the breathing treatment was administered to the child. A review of the daily attendance records found that the child was present at that time. 3) On 1/28/19 and 2/1/19 a parent requested that DG pain reliever be administered to their child at 11:30 a.m. On 1/28/19 it was documented that the medication was not administered until 2:30 p.m. 4) On 2/4/19 it was requested by a parent that a children's pain reliever, Dimetapp and Flonase be administered to their child at 11:30 a.m. However, the form used to document when a medication is administered showed two (2) blank lines where the name of the medication that was administered should be noted and then the time of 2:30 p.m. and a staff person's name.
