General: Based on observation and interview, this regulatory requirement was not met. During a tour of the facility, the surveyor noted the following: 1. The staff person in charge was wearing a face shield throughout the entire survey; however, was not wearing a face mask. 2. When the surveyor entered the facility kitchen, the staff person was not wearing a face covering of any kind. As soon as the surveyor entered the kitchen area, the staff person reached for a face shield and wore it while the surveyor was in the kitchen; however, was not wearing a face mask. The staff person removed the face shield as soon as the surveyor exited the kitchen area. These situations were discussed with the staff person in charge during the visit. The staff person in charge stated that she thought it was acceptable for her to only wear a face shield because she occasionally covers breaks in the infant/toddler classrooms. The staff person in charge stated that the kitchen staff person has a medical condition which causes her to have difficulty breathing while wearing a mask; therefore, she does not wear one. The staff person in charge further stated that a health department representative witnessed the staff person not wearing a face covering on a recent visit to the facility and told the staff person that it was acceptable. General: Based on interview and review of documentation, the child-care center failed to ensure the health, safety, and comfort of a child in care. The director reported an incident involving a three-year-old child and a staff person to the Division of Regulated Child Care on 1/18/19. A review of the report found a three-year-old child was washing her hands for an extended period and had refused to leave the area after repeatedly being asked to by a staff person. The staff person picked up the child by her upper arms in order to move her away from the handwashing sink and place her in "time-out." Interviews with staff conducted on 1/23/19 found that they observed the child "digging and wringing" in her arm and crying. Staff indicated they thought the child was crying due to being in "time-out" and thought she was just having an emotional day. The child went to the doctor the next day and diagnosed with having a strained muscle in her left forearm. In an interview with the staff person in question it was found that on 1/17/ 19 she told the child several times to stop playing in the water and when she refused, she picked up the child underneath her arms and carried her approximately three (3) feet across the room to the cubby area. Based on review of documentation, the surveyor found the first accident/ incident report written by the staff person reads as follows “…..refusing to listen to the teacher when I asked her to leave the sink area after washing her hands for an extended period of time, so I picked her up by her forearms. She dropped to the floor and I picked her back up by her forearms and carried her to the wall for time-out.” A second accident/ incident report amended by the staff person reads as follows “….refusing to listen to the teacher when I asked her leave the sink area after washing her hands for an extended period of time, so I picked her up by her upper arms to take her to time-out. She dropped to the floor and I picked her back up by her upper arms and carried her to the wall for time-out.” A review of medical documentation received on 2/7/19 found the child was examined at Harrodsburg Urgent Treatment Center the evening of 1/18/19. Per the report it was found the child’s medial, lateral, and anterior potion of her left elbow forearm were tender.
