The charging cord to the classroom tablet was hanging from the miniature refrigerator in the classroom in reach of children in care. Sage Classroom 1. Several cords were plugged in and laying on top of the art center in reach of children in care. Large Playground 1. A large black storage box at the far end of the playground had a lid askew that had allowed for rainwater to fill a tote with various play balls, resulting in standing water, approximately eighteen (18) inches deep. A three-year-old child in care was inspecting the storage box and placing their hand into the space, though unable to touch the water. Staff could see and hear the child, though standing water poses a drowning hazard.

General: Based on interviews, a staff member who was named as an alleged perpetrator in two (2) active child abuse/neglect cases accepted by the Cabinet was permitted to continue working and had direct contact with children at the facility from 07/28/25 through 09/17/25. During this time, the staff member worked Monday through Friday from 1:00 PM to 6:00 PM in the Infant Classroom and was not left alone with children. On 07/18/25, the staff member informed child care management that she had been named as an alleged perpetrator in a case involving her own children. Following this disclosure, the staff member’s caseworker advised management that she could continue working, but she was not permitted to have direct contact with her own child—who is also enrolled at the center—unless supervised by management. During an interview conducted on 09/17/25, the staff member confirmed that she returned to work on 07/28/25 and had continued working up to the date of the interview. The staff member in charge confirmed that she became aware of the active investigation involving the staff member’s own children on 07/20/25 and stated that she believed the staff member was permitted to continue working. However, she also acknowledged that the staff member continued working in the Infant Classroom after a second investigation was initiated, in which the staff member was named as an alleged perpetrator in a case involving an unrelated child enrolled at the center.

It appeared that the children had just finished lunch, due to discarded food on the table and floor. The surveyor noted that one male toddler was crying, and another male toddler was asleep with his head on the table. Two staff were putting nap sheets on cots and placing the cots around the classroom. One staff member told the surveyor that the children eat for approximately 30 minutes, and then it takes approximately 15 minutes to prepare for naptime. A review of the daily schedule found that lunch and nap preparation occurs from 10:40 a.m. until 11:20 a.m. During the observation, both staff at different times lifted the sleeping toddler’s head and say, “You can’t go to sleep yet.” In addition, they kept telling the child who was crying that "he would be okay". At approximately 11:12 a.m., another toddler started crying. The surveyor noted at 11:20 a.m., all seven children were still sitting at the table. The surveyor noted at 11:30 a.m., all but one toddler had been removed from the table. In short, the toddlers were confined in their bucket seats for a relatively long period, i.e., 50 minutes. While touring the two (2) year old classroom, the surveyor observed a cellphone positioned in a pocket labeled "Circle Time Center" that was hanging on the wall. General: Based on Observation, during a tour of the eating area the door leading to the room where food and cleaning supplies as well as a food warming unit is stored was open. The warming unit was warm to the touch and in use. On the two (2) bottom racks of a wire shelf there were many bottles of cleaning supplies that included but are not limited to Windex, floor cleaner, Comet, disinfecting wipes, Odo Ban, Scrubbing Bubbles and Lysol spray disinfectant. On a cart in the same room there were additional cleaning supplies. In the unlocked cabinet under the sink there was a bottle of Odo-Ban cleaner. The containers all bore labels "Keep Out of Reach of Children" and/or "Flammable." Seventeen (17) two and three year old children were observed to sit along the wall next to this storage room while preparing to go outside and play. A staff member in the infant room gave the drops to the child at 2:15 PM, but failed to complete the medication form indicating that the drops were given. Later in the afternoon another staff member came into the room and saw the medication form and noticed that the child did not receive the drops, since the form was not completed. The afternoon staff member gave the child the ear drops at 4:30 PM. Based on interviews the infant was given the ear drops 2 times within a two (2) hour and fifteen minute period. It was not discovered that the drops were given two (2) times until the next day when the parent obtained the medication form and she was getting ready to complete it for the day. The parent indicated that a staff wrote a note on her child's daily form about giving ear drops at 2:15 PM and then the medication administration form stated another staff gave the ear drops at 4:15 PM on 8/27/15. The parent indicated that the infant's ears became red and irritated the night before and she realized that the child was given the drops by two (2) different staff on the same day. The parent called the infants doctor and poison control as indicated on the box of ear drops. The infant had to discontinue the ear drops for a few days until the irritation and redness subsided.
