General: Based on interview and review of documentation, a twenty-seven-month-old child sat on the floor and a caregiver extended her hands to the child for the child to stand up while in the transitional room on 1/5/23. The child held onto the caregiver’s hands, stood up, and then forced himself back down to the floor while the caregiver held the child's hands. A few minutes later the child cried, complained his right arm hurt, and the right arm became discolored. The child was taken for medical treatment, and it was determined the child had a nursemaid elbow on 1/5/23. In addition, interviews determined the same twenty-seven-month-old child fell from the steps at a sink in the transitional room on 10/20/22. A review of the center’s report of unusual occurrence indicated a staff noticed the child’s wrist was swollen and notified a parent. The child had an x-ray taken of his right arm on 10/20/22, and it was determined he had a broken right arm. A cast was placed on his right arm on 10/21/22. The center was made aware the child received medical care on 10/21/22. The center failed to notify the cabinet, within twenty-four hours from the time of discovery, that a child received medical care from injuries which occurred at the center on 1/5/23 and 10/21/22. Interview revealed that a one year old child enrolled in August 2013 received a bump on her head at approximately 9:30 am on May 2, 2014 when another child pushed her and she fell to the floor hitting her head while playing in the toddler classroom. This same child received a second injury leaving a bruise on her chin at approximately 1:30pm while playing in the infant classroom and she fell hitting her chin on a bouncy seat. A third injury was sustained at approximately 4:30 pm when the same one year old child was again playing in the infant classroom and fell cutting her eye on a toy piano. The director acknowledged in interview that although the parent of the child insisted that she be placed in the one year old classroom upon turning one year old, the director had reservations regarding this decision based on her observation of the child’s abilities. Record review revealed an incident report on file dated May 2, 2014 describing a head injury to the child enrolled August 2013. Additional incident reports for injuries sustained on May 2, 2014 were not available for review at the time of the investigation.

Based on interview with several staff members, this has occurred on several other instances between September 2013 and December 9, 2013, in which the same child threw his food onto the floor and the same staff member stated to the child that he would not be allowed to eat as he had thrown his food onto the floor.
