The other staff member was observed working with a qualified staff member in the Infant room with ten (10) infants. Review of the center's Kentucky Applicant Registry and Employment Screening (KARES) report revealed the staff member who was observed in the Preschool classroom submitted her fingerprints and received a determination of eligibility on 3/18/2022. Further review of the KARES report and interview with the staff in charge revealed the staff member who was observed in the Infant room has not received a current determination of eligibility. However, the individual was previously determined to be eligible for employment for a different child care center in 2018. Additionally, it was determined that the staff member recently changed her last name, resulting in complications in completing the required background checks. General: Based on Review of Documentation, and interview, the child care center director failed to assure compliance with regulatory requirements. Review of a center incident report revealed on 6/29/16 a child was pushed causing him to fall into a wooden piece of equipment causing a red mark on his collar bone. Interview with a staff member revealed the three-year-old child cried after falling into the wooden piece of equipment. Continued interview with the staff member revealed the three-year-old child was not acting as he normally did. The staff member escorted the class out to the playground thinking it would make the injured child feel better. The injured child then began to climb up a ladder and immediately began to cry, saying he wanted his dad. The supervising staff member for the three-year-old child then called for the staff in charge that came to the playground and took the child to the center office. The staff in charge took a picture of the injured area on the three-year-old child and sent it to the director who was not on the premises. Interview with the staff in charge stated the father of the child arrived at the center a very short time after taking the child to the office. The staff in charge did not contact the parents of the three-year-old child concerning the injury. Interview with the parent revealed as they were picking the child up by the arm pits to place him into the vehicle, he began to scream at which time the parent returned to the child’s classroom and asked what happened and then was told of the incident. The child was transported to the hospital by the parent where the three-year-old child was diagnosed with a broken collar bone. Interviews revealed the two (2) staff members who administered first aid on the three-year-old child were not certified in first aid and did not consult with the employee on site that was certified in first aid and had the child return to regular activities. Based on continued interviews, the staff in charge stated she observed the child standing in the bathroom and took the child to the office but was unaware how long the child had been in the bathroom. Additionally, the staff in charge stated a staff member had stated she had placed the child in the bathroom to "calm herself". Continued interviews revealed the staff member stating she had placed the child into the bathroom only until she calmed down after becoming upset over an incident regarding a piece of candy.
