General: Based on review of a staff’s (DOH: 07/21/15) file, the surveyor found a letter from the Cabinet for Health and Family Services, Department for Community Based Services (DCBS) dated 11/02/22, addressed to the staff person and stated that a report of suspected Child Abuse or Neglect was received on 12/30/21. The letter stated, “Based upon a review of existing evidence or the receipt of new evidence, the original substantiated finding has now been found to be unsubstantiated.” During interview, staff-in-charge stated that she was aware of the DCBS investigation involving the staff person; however, staff-in-charge stated that she and the staff person were not aware of the substantiated finding of child abuse or neglect involving the staff person. Staff-in-charge stated that the staff person continued to work at the child-care center during the investigation by DCBS. Staff-in-charge stated that the staff person worked in the Preschool Classroom and was never alone with the children. The surveyor did not observe the staff person working alone with children. Staff-in-charge stated that she became aware that there was an issue regarding the staff person on 10/03/22 when she was checking the KARES system. Staff-in-charge stated that she and her Coach were checking files to ensure she had everything she needed at that time. Staff-in-charge stated that she sent an email to KARES and received a response on 10/03/22. The staff’s file contained a copy of the email that stated the staff person had substantiations for Abuse and this was substantiated on 08/01/22. The email informed the staff person how to file an appeal and advised that if the staff person chose to appeal, she could continue to work at the child-care center in a provisional roll and not be left alone with the children. Staff-in-charge checked KARES during the surveyor’s visit and it showed that the staff person was under an appeal as of 10/25/22. The staff’s file contained a copy of an email that stated the appeal was scheduled for 12/05/22. Staff-in-charge stated that she and the staff person were never aware of the substantiated finding and assumed the investigation was over due to not receiving any paperwork. Staff-in-charge stated that it was a failure on her part for not reporting the DCBS investigation to DRCC and that it slipped her mind. Therefore, the report of child abuse or neglect was not reported to DRCC within twenty-four (24) hours from the time of discovery. A black iron gate separating the playground from another area of the playground that had broken zip ties and was not secure. Several stacked bricks were placed on the ground on the other side of the black iron fence. 4. A picnic table that contained a piece of broken wood underneath it with several exposed nails located on the playground. 5. An exposed line dangling from the soffit of the child-care building and going into a hole on the side of the building located beside a storage container on the playground. 6. An exposed line coming down the side of the building and going into a hole on the side of the building beside the gate entrance on the playground. 7. A black line dangling down from the soffit of the child-care building beside a wooden ramp leading into the child-care building. 8.
