General: Based on observation, the surveyor attempted to conduct a visit at the child care center on 03/10/25 at 11:43 am. Upon arrival, the surveyor rang the doorbell two (2) times with no answer. The lights appeared to be turned off inside the child care center. The surveyor contacted the branch manager by telephone to enquire if the child care center had reported a closure for this date. The branch manager contacted the child care center’s staff-in-charge via email on 3/10/25 at 11:50 am. General: Based on observation, the surveyor found the following: 1. One (1) gutter downspout that contained a sharp edge on the bottom of the gutter located on the edge of the child-care center building on the playground. 2. A puddle of water observed on top of what appeared to be a rubber black material used for a tricycle path located on the playground. The piece of rubber material appeared to contain a dip and the water did not appear to have a way to drain. During interview, staff-in-charge stated that the child-care center had a concrete bike track on order. Staff-in-charge stated that it had rained during the night and that was the cause for the puddle of water. 3. What appeared to be a long and slender tree branch coming over the top fence roll and sticking out located on the fence roll on the side of the playground by a building. 4. A tree that was observed to have fallen located by the back corner of the fence roll on the playground. A branch appeared to have been cut off; however, the branch was observed hovering over the top pole on the fence roll. The surveyor observed brush and vines around the tree branch and on top of the fence roll in the back corner of the playground. During interview, staff-in-charge stated that they were waiting on the vines to die to be able to cut the rest of the tree. There was a large bowl shaped table located on the playground which contained play sand that the children were using. There was no protective covering for the sand table. Staff reported that the sand in the table is not kept covered. This presents a health and safety risk to the children as the sand is not protected from vermin or other animals that may defecate in the sand. 2. There was approximately one (1) inch of standing water in the sink of the play kitchen located next to the play house on the playground. The water was accessible to the children playing on the playground. Staff reported that the playground is checked every morning for standing water. Review of the playground checklist for 10/17/17 revealed that staff had checked the playground and checked that the there was not standing water on the playground. General: Based on review of documentation, the surveyor found that the childcare center did not supervise staff conduct to ensure implementation of program policies and procedures: 1. The Child Abuse and Neglect Policy states, “ANYONE WHO KNOWS OR HAS REASONABLE CAUSE TO BELIEVE A CHILD IS NEGLECTED OR ABUSED MUST IMMEDIATELY REPORT IT TO THE OFFICE OF COMMUNITY BASED SERVICES AT 800-752-6200, STATE POLICE OR LOCAL POLICE”. On 04/25/17, at approximately 12:10 p.m., a staff person observed another staff upend a child’s cot and dump the child on the classroom floor. The staff person immediately intervened. The staff then reported the concern to supervisory staff that afternoon. According to the DPP – 115, the supervisory staff reported the incident to child protective services on the evening of 04/26/17 at approximately 5:00 p.m. Based on interview, the surveyor learned that the supervisory staff had “red flags” when learning of the incident; therefore, reasonable cause existed to believe that a child may be abused or neglected. Per the Head Start’s Policy, staff did not immediately report the incident to the proper authorities. 2. The TELECOMMUNICATIONS POLICY states, “PERSONAL CALLS AND PERSONAL CELL PHONE USE SHOULD BE LIMITED TO SCHEDULED BREAK TIMES AND SHOULD NOT INTERFER WITH STAFF JOB PERFORMANCE. EXCESSIVE USE CAUSING INTERRRUPTION TO JOB PERFORMANCE COULD LEAD TO DISCIPLINARY ACTION.” Review of video footage verifies that a staff person violated the Telecommunications Policy when she used her cell phone while supervising children during naptime on 04/25/17. Classroom video footage recorded on 04/25/17, confirmed that a staff person was physically and verbally inappropriate with a three-year-old child and a four-year-old child that refused to lay quietly on their cots during naptime. The staff threatened to take away their outdoor playtime, toy bear and shoes. The staff person twisted the three-year-old child's wrist, foot and toes. She hit the three-year-old child on his leg using a cell phone and threw his shoes into the hallway narrowly missing a sleeping child. On five (5) occasions, she squeezed the backs of the two (2) children's necks. The children cried, rubbed their necks and asked the staff person to let go. The staff person repeatedly grabbed the children by their arms and aggressively shoved the four-year-old child's head to push him down onto his cot. She upended their cots; thus, dumping them onto the classroom floor. 2. Staff interviews conclude that a staff person assisted a preschool-age child over the playground fence to obtain a Frisbee. General: Based on review of documentation and of video footage, the surveyor found that a staff person used inappropriate discipline and loud, threatening language with two (2) preschool-age children that refused to quietly rest during naptime. Video footage recorded on 04/25/17 and multiple interviews, finds that a staff person used threats, intimidation and physical force in an attempt to make the two (2) children lay quietly on their cots. Video footage revealed that on five (5) occasions, the staff person squeezed the backs of the children's necks. The staff person repeatedly grabbed the children by their arms and aggressively shoved the four-year-old child's head to push him down onto his cot. The staff person hit the three-year-old child on his leg using a cell phone, twisted his foot, pinched his toes and threw his shoes into the hallway narrowly missing a sleeping child. She also threatened to flip the children off their cots onto the floor. She followed through with her threat by dumping both of the children onto the floor. Staff interviews conclude that the staff person has previously used a threatening tone of voice and has made the children lay on their cots in the classroom during playtime as punishment.
