During an investigation, it was determined that on November 18, 2025, at approximately 8:02 a.m., three infants were present with one staff person. The staff person placed a 5-month-old infant into a high chair. The staff member fastened the lap belt of the high chair but did not fasten the shoulder straps. The staff person then put the tray in place and turned briefly to get a cell phone to play music. The tray came off the high chair, resulting in the child falling out of the high chair and striking their head on the overturned tray. The staff person observed the infant’s forehead bleeding and immediately called out for assistance. First aid was administered and the parent was notified. The parent arrived and transported the infant to a nearby hospital. The child was diagnosed with a head injury and the laceration to the forehead was closed with six stitches. The three-point harness on the highchair was not used in accordance with the manufacturer’s instructions.

During an Incident Investigation & Follow Up conducted on July 25, 2022 ; It was determined based on observation that the center capacity exceeded classroom A-Front's licensed capacity of 18 when it was observed that staff members cared for 27 children in the classroom. Furthermore, the center exceeded their overall licensed capacity of 40 when it was observed that the staff members cared for approximately 43 children during the visit. Exhibit "A"
