591-1-1-.11(2) · Rule 591-1-1-.11(2) requires that personnel shall not: physically or sexually abuse a child or engage or permit others to engage in sexually overt conduct in the presence of any child enrolled in the center; inflict corporal/physical punishment upon a child; shake, jerk, pinch or handle a child roughly; verbally abuse or humiliate a child which includes, but is not limited to, the use of threats, profanity or belittling remarks about a child or his family; isolate a child in a dark room, closet or unsupervised area; use mechanical or physical restraints or devices to discipline children; use medication to discipline or control children's behavior without written medical authorization issued by a licensed professional and given with the parent's written consent; restrict unreasonably a child from going to the bathroom; punish toileting accidents; force-feed a child or withhold feeding a child regularly scheduled meals and/or snacks; force or withhold naps; allow children to discipline or humiliate other children; or confine a child for disciplinary purposes to a swing, highchair, infant carrier, walker or jump seat.
During an investigation, it was determined that on November 10, 2025, inappropriate discipline was used when a staff member grabbed a 4-year-old child and pulled them forcibly out of a chair. During a transition after lunch, the 4-year-old child was sitting at a table and threw a toothbrush. A staff member that was standing behind the child’s chair grabbed the back of the child’s neck, then grabbed the child’s right wrist and left arm and pulled them out of the chair to a standing position. The staff member then pushed the child by their upper arm to the rug to pick up the toothbrush and led the child back to the table where the staff member forcibly sat the child back in their chair. The child sustained a scratch on the left side of their neck.

591-1-1-.07(2) · Rule 591-1-1-.07(2) requires that parents must be notified of a child's incidents, illnesses or injury as follows: Immediately notify Parent(s) and obtain specific instructions until child can be picked up or returned to group. • When professional medical attention is required, or • When child experiences symptoms of moderate discomfort such as elevated temperature, vomiting or diarrhea., or When child is involved in an incident that puts their health and/or safety at risk (e.g., missing from program, left on vehicle, escaped from building/playground, etc.) Notify Parent(s) by the end of the day. • When professional medical attention is not required, or • When child experiences symptoms of less than moderate discomfort, or • When child experiences an adverse reaction to prescribed medication which does not constitute moderate discomfort.
During an investigation, it was determined that on August 16, 2024, a four-year-old child sustained an injury to the left arm after falling on the playground. The child was observed to have moderate discomfort and the child’s parents were not notified immediately. The injury occurred around 12:30 PM and the parents were not notified to pick up the child until 1:30 PM. The injury required professional medical attention.

During an investigation, it was determined that on August 16, 2024, staff did not keep a four-year-old child comfortable after a fall on the playground resulting in a left arm injury. The child cried from the time of the incident around 12:30 PM until the parent picked up at 1:30 PM. The child was observed to rub their left arm due to the pain. The injury required professional medical attention.
