During an investigation, it was determined that on February 6, 2025, at 4:53 p.m., a 6-year-old child was injured after the child jumped from a piece of playground equipment, fell, and hit their head. There was one staff member and six children ranging from four to eight years of age on the playground. The staff member was positioned toward the back of the playground while the children were participating in play activities by throwing dirt in the sand box at each other, running through the stationary fire truck equipment and jumping off the equipment. The staff member did not observe the child fall and was unaware of where the child hit their head on the equipment. The staff member failed to redirect the school aged children’s behavior while on the playground. The 6-year-old child ran through the fire truck, fell, and hit their head resulting in a laceration on the side of their head. Staff failed to intervene with the children while on the playground when the 6-year-old child utilizes the play equipment in an unsafe manner, which resulted in the 6-year-old child being injured. The child required professional medical attention and received professional medical attention.

During an investigation, it was determined that on May 21, 2024, at 3:00 p.m., an autistic, four-year- old child was inappropriately disciplined by a staff member while on the playground. Staff member A jerked and grabbed the child several times with the child's hands and arms. The staff member forcefully made the child sit on the ground and near a fence. The child showed signs of distress and started to cry, kick, pinch, and pat the staff member. In response to the child's behavior, staff member A threatened the child and yelled in the child's face when the child attempted to stand or pull away from the staff member. Staff member A spanked the child on their bottom area, as well as slapped the child as a form of discipline. Staff member B circulated the playground and was positioned to see the incident, however, staff member B did not intervene with staff member A’s disciplinary practices towards the child. The staff member's inappropriate actions were intervened by a bystander.

The staff member was arrested and charged with first-degree cruelty to children on May 23, 2024. 3. Rules 591-1-1-.11(1) requires Disciplinary actions used to correct a child’s behavior, guidance techniques and any activities in which the children participate or observe at the Center shall not be detrimental to the physical or mental health of any child.
