    591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the childcare area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty- six (36) months of age and younger.

    During an incident investigation closure, it was determined that on March 11, 2024, at 2:36 p.m., a two-year- old child sustained a large knot to the head and staff had their back turned to the child at the time the incident occurred. There was one staff member and three, two-year-old children in the classroom. According to video footage, the staff member was observed preoccupied with watching television, with their back turned from the children at the time of the incident. A child was observed sitting in a white folding chair and the two-year-old child was observed climbing on the back of the chair that the other child was sitting in. The two-year-old child pulled the white folding chair and the other child sitting in the chair fell on top of the two-year-old child and onto the floor. After the incident, the staff member was observed looking back at the children, walking over, picking up the white folding chair, and sitting the chair back up. The staff member then walked back to a different area of the room and proceeded to watch television. Professional medical attention was obtained, and the child was diagnosed with a head injury.

    It was determined based on an investigation that on March 11, 2024, center staff did not provide comfort to a two-year-old child following an injury in the classroom. The two-year-old child climbed on the back of a white folding chair another child was seated in, resulting in the chair and the other child falling on top of the child, causing a head injury, while the center staff had their back turned watching television. The child cried out in pain, and the staff member picked up the chair, but did not provide individual attention or comfort to the injured child. Professional medical attention was received.

    During a Licensing Study on July 17, 2023, it was determined based on consultant's observation that four school aged children were alone in Classroom B when consultant arrived for visit. Additionally, the staff assigned to the room went to the classroom within two minutes after the consultant arrived. The staff member assigned to the classroom also serves as the director, stepped to the front of the building to observe who entered into the building.
