591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty-six (36) months of age and younger.
It was determined based on investigative findings that center staff failed to provide watchful oversight when a one- year-old child received burns to their right upper arm, under right arm, chest/upper back, and right hand when they reached the top of a cabinet, pulled the cord of a bottle warmer, causing the hot water to spill on the child. Professional medical attention was obtained.

It was determined based on an investigation that on October 19, 2022 at 3:59 p.m., center staff failed to ensure that hazardous equipment was inaccessible to children when a one-year-old child pulled a cord attached to a bottle warmer down, which caused burns to the child's right upper arm, under right arm, right hand and chest/upper back.

During a complaint closure conducted on June 28, 2021, it was determined based on staff statements and interviews that on June 7, 2021, a one-year-old child's front tooth was missing, and the staff was not able to report how the injury occurred is substantiated. Staff statements and interviews revealed that they were unaware of the one-year-old child's tooth being chipped until the parent brought the child back to the center thirty minutes after pickup time.

During a complaint closure conducted on November 9, 2021, it was determined during an investigation that on November 4, 2021, center staff failed to provide watchful oversight to children at the center. During the day of investigation consultant observed children to be in the hallway, sitting, walking and running with no staff supervision. Consultant asked the children in the hallway where was their teacher and were they in hallway by themselves, they replied back saying "Yes and they did not know where their teacher was". Consultant observed that in classroom #4 children were napping and staff was outside with the door cracked. Consultant asked staff why was she outside? Staff stated that she was outside getting fresh air. $499.00 3.

During a incident investigation closure on January 4, 2022, it was determined based on investigative findings that on November 8, 2021, at approximately 8:48 a.m., a two-year-old child sustained an injury to the finger when another child shut the classroom door on the two-child-old child’s finger. The children were transitioning to their classroom when the two-year-old child and another child ran from the room. The other child closed the two-year-old child’s finger in the door. When the injury occurred the staff person was not in the classroom with the children. Professional medical attention was obtained.

Consultant further observed classrooms 5 and 8 to have lysol wipes, lysol spray accessible to children in unlocked cabinets.
