591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children be supervised at all times appropriate to the individual age, needs and capabilities of each child. During an investigation, it was determined that on March 6, 2025, at 2:55 p.m., the center staff did not provide watchful oversight when a 6-year-old child was left on the center’s bus for approximately one hour. There were 13 other children on the bus, as the child fell asleep on the bus. The outside temperature was approximately 54 degrees. The children exited the bus, and the center staff was unaware of the sleeping child on the bus. The child exited the bus and was found by a parent walking alone and without staff supervision. As required by the Department, the center staff did not scan all areas on the bus that were occupied by the children. Furthermore, the center staff did not maximize their ability to see all of the children that were listed on the roster when the children entered the center from the bus.

591-1-1-.36(7)(c)2. · Rule 591-1-1-.36(7)(c)2. requires that the driver or other designated person shall immediately document in writing, with a check or other mark/symbol to account for each child listed on the passenger transportation checklist each time a child enters and exits the vehicle. During an investigation, it was determined that on March 6, 2025, the center staff failed to accurately document their transportation log as required by the Department when a 6-year-old child did not exit the vehicle. At approximately 2:55 p.m. the driver returned to the center, signed the transportation log indicating that the first check of the vehicle was completed, however no physical walk through of the vehicle was conducted as required. The 6-year-old child had fallen asleep while left on the vehicle and was later found wandering around alone in the center’s parking lot.

The child was later discovered alone in the center’s parking lot. As a result, a staff member was charged and arrested for reckless conduct.

During a Complaint Closure conducted on December 8, 2023 ; It was determined based on an investigation that on November 10, 2023 and November 13, 2023, a four-year-old child was bitten on the forearm by the same enrolled child. During a Complaint Investigation & Monitoring Visit conducted on March 11, 2024 ; It was determined based on observation that the center failed to supervise children at all times when center staff allowed a four-year-old child to walk out of the classroom to the front office unsupervised on this date. The director observed the child and walked the child back to the classroom after the child left the front office.
