591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children shall be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in- Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty-six (36) months of age and younger.
During an incident investigation and follow-up visit conducted on April 29, 2024, it was determined based on staff statements, interviews and video footage that a three-year-old child was out of the classroom when a staff member closed the child’s finger in the classroom door. The child was observed to be in the center’s lobby area when the incident occurred. The staff member closed the door without checking on the location of the child. The child received professional medical attention. 2. Rule 591-1-1-.21(1)(p) a written plan for handling emergencies, including but not limited to severe weather, loss of electrical power or water and death, serious injury or loss of a child, a threatening event, or natural disaster which may occur at the Center. The Center will have in place procedures for evacuation, relocation, shelter-in-place, lock-down, communication and reunification with families, and continuity of operations. The plan must apply to all children in care and include specific accommodations for infants and toddlers, children with disabilities, and children with chronic medical conditions. Such plan shall include assurance that no Center Personnel will impede in any way the delivery of emergency care or services to a child by licensed or certified emergency health care professionals. During an incident investigation and follow-up visit conducted on April 29, 2024, it was determined based on staff statements, interviews and review of the center’s policies and procedures, that the center did not follow their policy and procedure guidelines during an incident. A three-year-old child was transported to the hospital, alone, via ambulance, due to an incident that required professional medical attention. The center’s policy states the Director or Assistant Director will accompany the child.

During an incident investigation conducted on December 13, 2023, it was determined based on staff statements, interviews and video footage, that on December 6, 2023, staff were not adequately supervising children when a ten month old child pulled a bottle warmer on to themselves. The staff was observed to be sitting on the floor, feeding another child, when the incident occurred. The child received professional medical attention.

During an investigation, it was determined that on December 6, 2023, a 10-month-old child was not adequately supervised when they were able to pull on the electrical cord of a bottle warmer, that was on top of the refrigerator in the classroom. The staff member who was responsible for providing watchful oversight to the children had their back to where the child was located and could not see what the child was doing. The child pulled on the electrical cord and the bottle warmer, and its contents fell off of the refrigerator. As a result, hot water splashed on the child which resulted in the child requiring professional medical attention for second degree burns. .

591-1-1-.25(13) · Rule 591-1-1-.25(13) requires that potentially hazardous equipment, materials and supplies shall be stored in a locked area inaccessible to children. Examples of items to be stored include non-food related products under pressure in aerosol dispensing cans, flammable and corrosive materials, cleaning supplies, poisons, insecticides, office supplies and industrial-sized or commercial buckets with a capacity of three gallons or more or any other similar device with rigid sides which would not tip over if a toddler fell into the container head first.
During an investigation, it was determined that on December 6, 2023, a 10-month-old child sustained burns to their elbow, arm, wrist, belly, and both feet, while in the classroom. The child was able to pull on the electrical cord of a bottle warmer. The electrical cord was accessible to the children, and as a result a child was able to pull the electrical cord of a bottle warmer. The contents of the bottle warmer splashed on the child, which resulted in the child requiring professional medical attention for second degree burns.
