591-1-1-.26(4) · Rule 591-1-1-.26(4) requires that playgrounds be protected from traffic or other hazards by a (4) four foot high fence or other barrier approved by this Department. Fencing material shall not present a hazard to children and shall be maintained so as to prevent children from leaving the playground area by any means other than through an approved access route. Fence gates shall be kept closed except when persons are entering or exiting the area.
During a Licensing Study conducted on February 25, 2025 ; It was determined based on observation that the top fence poles near the back portion of the playground were detached which caused a bend in the fence. It was further determined that the back and left portions of the fence measured less than 4 feet high and there was an opening near the wooden fence that measured 12 inches wide that was accessible to children near the right side of the playground.

The responsible person shall physically walk through the entire vehicle; visually inspect all seat surfaces, under all seats and in all compartments or recesses in the vehicle's interior; and sign the passenger transportation checklist(s), indicating all of the children have exited the vehicle. There shall be continuous watchful oversight of the vehicle between the first check and second check.

591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the childcare area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty- six (36) months of age and younger.
During an incident investigation, it was determined that on February 11, 2025, at the time of incident there was a ratio of two staff members and 18 children in the fellowship hall. At 3:40 p.m., the class exited the center building as staff members escorted the children from the cafeteria to the fellowship hall. While in the fellowship hall staff witnessed the five-year-old child playing while in the fellowship hall. At approximately 4:10 p.m., the five-year-old child exited the fellowship hall unsupervised and staff members were unaware of the child’s departure. The staff members stated they searched the fellowship hall but were unable to locate the missing child. According to the witness statements a passerby discovered the five-year-old child wandering near the road, unattended. The passerby approached the child, and the child ran to the front door of a nearby law firm, knocked on the door and attempted to enter the door. Staff at the law firm assisted the passerby to retrieve the five-year-old child to safety. At 4:25 p.m. the passerby contacted a relative by telephone FaceTime, who confirmed the child's identity and then the center management was notified about the incident. Staff failed to actively supervise and provide watchful oversight to the children in the fellowship hall. Additionally, it was determined that the staff members were not able to respond promptly to the needs and actions of the child being supervised. The child received no professional medical attention.

591-1-1-.08(6) · Rule 591-1-1-.08(6) requires that records of a child’s daily arrival and departure for the twelve (12) preceding months shall be maintained but need not be filed in each child’s record. The Parent or person(s) authorized by the Parent to drop off and pick up the child will document, in written or electronic format, each time the Parent or authorized person drops off and picks up the child. The documentation shall include at least the following information: the date, the child’s name, the arrival and departure times, and the signature or initials of the Parent or authorized person at the time of arrival and departure. These records shall be made available to the Department in printed or written form upon request.
During an investigation, it was determined that on February 11, 2025, staff failed to complete children’s arrival and departure information as required. Staff failed to maintain arrival and departure records as required for eight out of 18 children who were present in the fellowship hall on February 11, 2025. A 5-year-old child exited the fellowship hall unsupervised and staff members were unaware of the child’s departure.

591-1-1-.29(3) · Rule 591-1-1-.29(3) requires the director or designated person-in-charge shall report or cause to be reported to the Department within twenty-four (24) hours or the next work day: any death of a child while in the care of the Center; any serious illness or injury requiring hospitalization or professional medical attention other than first aid of a child while in the care of the Center; any situation when a child in care becomes missing, such as, but not limited to, a child who is left on a vehicle, a child who leaves the building, playground, or property, or a child who is left behind on any trip; any fire; any structural disaster; any emergency situation that requires temporarily relocating children; and any time the program’s operating status changes (i.e., open to closed or temporarily closed and temporarily closed to open).
During an investigation, it was determined that on February 11, 2025, a 5-year-old child exited the fellowship hall unsupervised and staff members were unaware of the child’s departure. Center staff failed to submit a required report to the Department within 24 hours, or the next workday as required after becoming aware that the 5-year-old child in care became missing.
