591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children shall be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty-six (36) months of age and younger.
During an investigation, it was determined that on November 4, 2025, adequate supervision was not provided when a 2-year-old child pulled over a shelf in the classroom and sustained a broken left thumb that required professional medical attention. During music time, children moved around the room while the two staff members present were seated and engaged in a conversation with each other. The 2-year-old child and another child grabbed opposite ends of a shelf and moved in the same direction, causing the shelf to tip over and land on the 2-year-old child’s hand. The staff members did not maintain continuous visual supervision of the children during their conversation and were unaware that the child was injured until the child cried out.

591-1-1-.12(4) · Rule 591-1-1-.12(4) requires that equipment and furniture shall be secured if it is of a weight or mass that could cause injury from tipping, falling, or being pulled or pushed over. Potentially unstable equipment and furniture that might injure a child if not secured include, but are not limited to, televisions, chests of drawers, bookcases, shelving, cabinets and fish tanks. Examples of items not required to be secured include, but are not limited to, child-sized tables and chairs, rocking chairs, and cribs.

591-1-1-.25(13) · Rule 591-1-1-.25(13) requires that potentially hazardous equipment, materials and supplies shall be stored in a locked area inaccessible to children. Examples of items to be stored include non-food related products under pressure in aerosol dispensing cans, flammable and corrosive materials, cleaning supplies, poisons, insecticides, office supplies and industrial-sized or commercial buckets with a capacity of three gallons or more or any other similar device with rigid sides which would not tip over if a toddler fell into the container head first.
During an investigation, it was determined that on March 26, 2025, at 2:50 p.m., There was one staff member and six infants in the infant classroom. The staff member was seated in a rocking chair, rocking an infant and feeding the child. The 11-month-old infant was in a crib next to a refrigerator. The infant crawled to the opposite side of the crib, where the bottle warmer was positioned on the left side of the refrigerator. The 11-month-old infant reached through the crib slats, pulled the bottle warmer’s cord, which resulted in the bottle warmer falling into the crib, splashing the child with hot water. The staff member heard the bottle warmer fall and immediately went to check on the child. The teacher removed the bottle warmer from the crib, then put down the infant she was holding. The staff member picked up the 11-month-old infant, called for assistance, and rendered first aid. Administrative staff contacted the child’s parent and reported the incident. The child was taken for professional medical care and was treated for first and second degree burns to their abdomen. Staff failed to safely store the bottle warmer so that it was not accessible to children.
