591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm¶s length away from children thirty- six (36) months of age and younger.
During an Incident Investigation Closure conducted on January 21, 2025 ; It was determined based on investigative findings that on November 5, 2024, at approximately 4:27 p.m.,as a class returned inside from the playground, a two-year-old child was left on the playground unsupervised. The child walked out through a gate and at approximately 4:35 p.m., a witness found the child walking alone near the sidewalk and returned the two-year-old child to the center. The child remained unsupervised outside on the playground for approximately three-four minutes and staff were unaware that the two-year-old child was not with the class. An adverse action was previously issued for this rule violation. This rule violation is no longer appealable. No fine is being issued at this time.

During a Complaint Closure conducted on July 8, 2025 ; It was determined based on investigation that on June 16, 2025, a 2-year-old child sustained a bite on their lower left back which resulted in visible red teeth marks and staff did not observe the incident to happen to prevent it. Exhibit "A"

During a Complaint Investigation and Licensing Study conducted on February 7, 2025, it was determined based on investigative findings that on January 28, 2025, during nap time, center staff did not physically intervene to prevent a two-year-old child from sustaining a bruise and abrasion near the outside of their left eye while rocking back and forth on their cot and moving in a handstand motion.

The staff member failed to intervene and redirect the one-year-old child when the child engaged in an activity that was detrimental to their health. Professional medical treatment was obtained.

It was determined based on an investigation that on November 5, 2024, at approximately 4:27 p.m., a two-year-old was left unsupervised on the playground and walked out through the playground gate door. The child remained unsupervised outside the playground for approximately three-four minutes, and staff were not aware of the incident. At the time of the incident, there were two staff members supervising 26 two-year-old and three-year-old children on the playground. At appropriately 4:27 p.m. the class returned to their classroom from the playground. The two- year-old child was left on the playground alone. Based on video footage, the child left the gated playground and walked alone near the sidewalk. A witness observed the unsupervised two-year-old child, retrieved the child and returned the child to the center. Staff were unaware of the two-year-old child’s whereabouts as the child was alone on the playground. The child sustained no injuries and did not require professional medical attention.
