591-1-1-.15(9) · Rule 591-1-1-.15(9) requires that a written statement be on file from a medical authority when a child requires a modified diet for medical reasons and from the child's Parent(s) when a child requires a modified diet for religious reasons. All caregiver Personnel shall be informed of the diet restriction for the child and only food that complies with the prescribed dietary regimen but still meets the food and nutrition requirements shall be served to the child.

During an investigation, it was determined that on June 10, 2022, at approximately 2:45 p.m. during special snack period a four-year-old child with a known food allergy to tree nuts was served an ice cream product that contained tree nut oil. After consuming the ice cream, the child began to vomit and develop hives. Center staff contacted the parent who arrived at the center and paramedics were called. Additionally, center staff failed to ensure that a written statement was on file from a medical authority for a four-year-old child that required a modified diet due to a tree nut allergy and staff were unaware of how to treat the allergic reaction. The child received professional medical attention.
