591-1-1-.06(4) · Rule 591-1-1-.06(4) requires a Center first licensed after March 1, 1991, and Centers that remodel or add to existing plumbing facilities, to have the bathroom area fully enclosed and ventilated to the outside of the building with either an open screened window or functioning exhaust fan and duct system and requires Centers without fully enclosed bathrooms to ensure there is adequate ventilation to control odors and adequate sanitation measures to prevent the spread of contagious diseases.

During a Monitoring Visit conducted on June 8, 2022 ; It was determined based on observation that the restrooms in classroom C first right did not have ventilation and the window would not open. It was further determined that based on observation the restrooms in classroom E did not have ventilation and the window would not open.

During a Licensing Study conducted on November 16, 2021 ; It was determined based on a review of documentation that medication given on August 24, 2021 through August 27,2021 did not include the date of when the medication would have been given.

A medication form for medication to be dispensed from July 18, 2022, through July 22, 2022, did not have the parental signature. A medication was authorized to be administered to a child between July 18, 2022, through July 22, 2022, at 11:00 a.m. During that time the medication was not administered on July 21, 2022, and July 22, 2022, at 11:00 a.m. A medication was authorized to be administered to a child between July 25, 2022 and July 29, 2022 at 11:00 a.m. During that time the medication was not administered on July 29, 2022 at 11:00 a.m. A medication was authorized to be administered to a child between September 19, 2022, through September 23, 2022, for every two hours. During that time the medication was not administered on September 20, 2022, at 12:00 p.m. and 2:00 p.m., September 21, 2022, at 12:00 p.m. and 2:00 p.m., September 22, 2022, at 12:00 p.m., 2:00 p.m., and 4:00 p.m., and September 23, 2022, at 10:00 a.m., 12:00 p.m., 2:00 p.m., and 4:00 p.m. A medication was authorized to be administered to a child between September 26, 2022, through September 30, 2022, at 8:00 a.m., 12:00 p.m., and 4:00 p.m. During that time the medication was not administered on September 26, 2022, through September 30, 2022, at 8:00 a.m., 12:00 p.m., and 4:00 p.m. A medication was authorized to be administered to a child between October 18, 2022, and October 26, 2022 at 12:00 p.m. During that time the medication was not administered on October 18, 2022, October 20, 2022, October 24, 2022, October 25, 2022, October 26, 2022, at 12:00 p.m. A medication was authorized to be administered to a child between October 31, 2022, through November 4, 2022, at 11:00 a.m. and 3:00 p.m. During that time the medication was not administered on October 31, 2022, at 3:00 p.m.

591-1-1-.11(2) · Rule 591-1-1-.11(2) requires that Personnel not: physically or sexually abuse a child or engage or permit others to engage in sexually overt conduct in the presence of any child enrolled in the Center; inflict corporal/physical punishment upon a child; shake, jerk, pinch or handle a child roughly; verbally abuse or humiliate a child which includes, but is not limited to, the use of threats, profanity or belittling remarks about a child or his family; isolate a child in a dark room, closet or unsupervised area; use mechanical or physical restraints or devices to discipline children; use medication to discipline or control children's behavior without written medical authorization issued by a licensed professional and given with the parent's written consent; restrict unreasonably a child from going to the bathroom; punish toileting accidents; force-feed a child or withhold feeding a child regularly scheduled meals and/or snacks; force or withhold naps; allow children to discipline or humiliate other children; or confine a child for disciplinary purposes to a swing, highchair, infant carrier, walker or jump seat.

During a Complaint Investigation by Phone conducted on June 21, 2022 ; It was determined based on investigative findings that a staff member roughly grabbed a child while on the playground.

During a Licensing Study conducted on October 31, 2022 ; It was determined based on observation that a staff member was observed to force a two-year-old child into a chair, from a standing position. The staff person was observed to hold the chair close to the table to prevent the child from getting up. It was further determined that the staff member, in the two-year-old classroom, yelled loudly at the two-year-old children.

During a Licensing Study conducted on November 16, 2021 ; It was determined based on review of records that staff member #5 did not have the four clock hours of training in food nutrition planning, preparation, serving, proper dish washing and food storage as required.
