    591-1-1-.11(1) · Rule 591-1-1-.11(1) requires that disciplinary actions used to correct a child’s behavior, guidance techniques and any activities in which the children participate or observe at the Center shall not be detrimental to the physical or mental health of any child.

    During an investigation, it was determined that on May 15, 2024, a staff member placed a four-year-old child in a dark bathroom for two minutes and prevented them from exiting as a form of discipline. On the same day, the same staff member placed a three-year-old child in a dark bathroom for two minutes and prevented them from exiting the bathroom. The staff member was observed to continue pressing the door closed as the children kicked and screamed and pushed the door attempting to open it. When the door was observed to open slightly the staff member continued to push the door closed. 2. Rule 591-1-1-.31(13) prohibits Center Staff from committing any criminal act, as defined under Georgia law, in the presence of any child enrolled in the Center and requires Center staff to comply with all applicable laws and regulations. During an investigation, it was determined that on May 15, 2024, a staff member placed a four-year-old child in a dark bathroom alone for two minutes and blocked the exit. The same staff member then placed a three-year-old child in a dark bathroom for two minutes and blocked the exit. As a result, on June 21, 2024, the staff member was charged with two counts of First Degree Cruelty to Children and one count of Simple Assault.

    During an investigation, it was determined that on May 21, 2024, a staff member grabbed a five-year-old child by the upper arm and escorted the child to an adjacent bathroom as a form of discipline. The child sustained three red abrasions, one of the marks broke the skin.

    During an investigation, it was determined that on May 21, 2024, a five-year-old child sustained an injury after being inappropriately disciplined. The center reported the incident to the Division of Family and Children Services on May 25, 2024; however, the Center did not report to the Department within the 24-hour time frame or the next business day that a report had been made to the Division of Family and Children Services.     During a Licensing Study conducted on August 10, 2022 ; It was determined based on observation the following hazards were accessible to children in care: * Bleach water solution was located underneath the diaper changing table in an unlocked cabinet in Classroom A (first left). * A stapler and "Miracle Grow" potting mix labeled, "keep out of reach of children" were located underneath the diaper changing table in unlocked cabinets in Classroom B (second left). * Baby wipes labeled, "keep out of reach of children" were located underneath the diaper changing table in unlocked cabinets in Classroom A (first left), Classroom B (second left), and Classroom C (third left). Baby wipes were also in containers to the right side of the classroom in Classroom J (first right). * A toilet plunger was located in the girl's bathroom in Classroom H (third right). An adverse action was previously issued for this rule violation. This rule violation is no longer appealable. No fine is being issued at this time.

Baby wipes were also in containers to the right side of the classroom in Classroom J (first right). * "Lysol" wipes labeled, "keep out of reach of children" were located in an unlocked cabinet underneath the sink in Classroom D (back left afterschool).     591-1-1-.26(6) · Rule 591-1-1-.26(6) requires that playground equipment provide an opportunity for the children to engage in a variety of experiences and shall be age-appropriate. For example, toddlers shall not be permitted to swing in swings designed for School-age Children. The outdoor equipment shall be free of lead-based paint, sharp corners and shall be regularly maintained in such a way as to be free of rust and splinters that could pose significant safety hazard to the children. All equipment shall be arranged so as not to obstruct supervision of children.

    During a Monitoring Visit conducted on March 18, 2022 ; It was determined that the following playground hazards were observed: * Playground B - Rust and chipped paint were observed on the four stairs of each side of the green and purple climbing structure. The side of the steps leading up onto the green and purple climbing structure were observed to be cracked and broken on both sides. At the top of the steps rust and chipped paint were also present. Additionally, rusted "O" hooks were observed at the top of the four swings along with rusted "S" hooks which connected the four seats of the swings. * Playground C - The side of the steps leading up onto the green and purple climbing structure was observed to be cracked and broken on both sides and at the top of the steps at the base. The hand rails were also rusted with chipped paint. * Playground D - The side of the steps leading up onto the red and purple climbing structure was observed to be cracked and broken on both sides and at the top of the steps at the base. The hand rails were also rusted with chipped paint.

    During a Complaint Investigation Follow Up conducted on October 25, 2022 ; It was determined based on observation that in Room H there was a staff:child ratio of 1:20 among 10 three-year-olds and 10 four-year-olds. A staff:child ratio of 2:20 was required. Further, a staff:child ratio of 1:12 among 8 two- year-olds and 4 three-year-olds was observed in Room J. A staff:child ratio of 2:12 was required.
