    591-1-1-.11(2) · Rule 591-1-1-.11(2) requires that Personnel not: physically or sexually abuse a child or engage or permit others to engage in sexually overt conduct in the presence of any child enrolled in the Center; inflict corporal/physical punishment upon a child; shake, jerk, pinch or handle a child roughly; verbally abuse or humiliate a child which includes, but is not limited to, the use of threats, profanity or belittling remarks about a child or his family; isolate a child in a dark room, closet or unsupervised area; use mechanical or physical restraints or devices to discipline children; use medication to discipline or control children's behavior without written medical authorization issued by a licensed professional and given with the parent's written consent; restrict unreasonably a child from going to the bathroom; punish toileting accidents; force-feed a child or withhold feeding a child regularly scheduled meals and/or snacks; force or withhold naps; allow children to discipline or humiliate other children; or confine a child for disciplinary purposes to a swing, highchair, infant carrier, walker or jump seat.

    During an investigation, it was determined that on April 23, 2024, a six-month-old infant was handled roughly when the infant was forcefully sat down on the floor repeatedly, each time the infant fell over, and staff attempted to put the infant in a seated position. The infant continued to fall over, causing the infant to hit their head on their floor multiple times. Additionally, when the child would not stay sitting up the staff member struck the child on the leg. The child required professional medical treatment and was diagnosed with a head injury. 2. Rule 591-1-1-.31(13) prohibits Center Staff from committing any criminal act, as defined under Georgia law, in the presence of any child enrolled in the Center and requires Center staff to comply with all applicable laws and regulations. During an investigation, it was determined that on April 23, 2024, a center staff member was observed to forcefully sit a six-month-old infant down on the floor repeatedly causing the infant to fall over and hit their head multiple times, resulting in a fractured skull. Additionally, the staff was also observed picking the six-month-old infant up and hitting the infant on the leg. The staff member was arrested on May 6, 2024, and charged with cruelty in the first degree.

    591-1-1-1.07(2) · Rule 591-1-1-1.07(2) requires that Parents be immediately notified and specific instructions obtained until the child can be picked up or returned to the group, immediately when professional medical attention is required, or when the child experiences symptoms of moderate discomfort, or when the child is involved in an incident that puts their health or safety at risk and notify Parents by the end of the day when professional medical attention is not required, when the child experiences symptoms of less than moderate discomfort or when the child experiences an adverse reaction to a prescribed medication which does not constitute moderate discomfort.

    During an investigation, it was determined that on April 23, 2024, center staff failed to notify the parents of a six- month-old infant when the child was involved in an incident that put their safety at risk. The six-month-old infant fell over multiple times and hit their head on the floor when the staff member forcefully sat the infant on the floor, which caused them to fall over. The infant continued to not be able to stay in a seated position and hit their head, as a result the staff member struck the infant on the leg. Staff reported that the infant had fallen during play and did not inform the parents that the infant had hit their head multiple times. The infant required professional medical attention for a head injury as a result of the incident.
