    591-1-1-.03(9) · Rule 591-1-1-.03(9) requires that staff shall not engage in, or allow children or other adults to engage in, $299.00 activities that could be detrimental to a child’s health or well-being, such as but not limited to, horse play, rough play, wrestling, and picking up a child in a manner that could cause injury.

    It was determined that on June 18, 2021, at approximately 4:20 p.m., center staff allowed children to engage in activities that were detrimental to a child’s health and well-being. There were three staff members and 11 two-year- old and three-year-old children in the classroom. On the date of the incident, two staff members walked a child to the front of the class for dismissal. The third staff member was in the back of the classroom, sitting on the floor, supervising children as they played with puzzles and blocks. The third staff member observed the two-year-old child follow the two staff members as they walked to the front of the class and pulled on the wooden cubby. The staff member also observed three other children pulling on the wooden cubby. The staff member did not redirect the children. The three staff members and office administration heard a crash sound and observed that the wooden cubby had fallen on top of the two-year-old child. Center staff administered first aid and contacted the child’s parents. Professional medical attention was required, and the child was diagnosed with a serious leg injury. This was a high severity citation. An enforcement fine was previously issued for this rule violation. This rule violation is no longer appealable. 2. Rule 591-1-1.32 (7) Supervision. Requires that children shall be supervised at all times appropriate to the $299.00 individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty-six (36) months of age and younger. It was determined that on February 1, 2022, watchful oversight was not provided when a three-year-old child walked out of the cafeteria unsupervised and walked out an unlocked door into the parking lot. Four staff members were supervising an infant, the victim child, a three-year-old child and two school-aged children in the cafeteria. At approximately 6:06 p.m., during pick-up of the three-year-old child and the two school-aged children, a staff member left the cafeteria to retrieve the three-year-old child’s belongings. Upon returning to the cafeteria, the staff member realized the victim child was missing. A few minutes later, the victim child’s mother walked the child back to the center. The child was missing for approximately two minutes.
