    591-1-1-.12(2) · Rule 591-1-1-.12(2) requires that equipment and furniture shall be free from hazardous conditions such as, but not limited to, sharp rough edges or toxic paint and shall be kept clean.

    During an investigation, it was determined that on February 24, 2026, staff failed to ensure a trash can was free of hazardous conditions when a 4-year-old child sustained a left elbow injury from the trash can. The 4-year-old child was sitting on the floor in the hallway when they moved their body and cut their left elbow on the trash can. The trash can was missing a piece which exposed a sharp edge. The injury required professional medical attention.

    591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children shall be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty-six (36) months of age and younger.

    During an investigation, it was determined that on February 24, 2026, staff did not ensure that watchful oversight was provided when a 4-year-old child sustained a left elbow injury from a broken trash can. There was one staff member in the hall with two children when the incident occurred. The staff member stated that they could see the two children out of the corner of their eye but was unaware of the injury until the child cried out. The injury required professional medical attention.

The child received professional medical attention on the same day. The center did not report the incident to the Department within 24 hours or the next work day as required. The center reported the incident on February 26, 2026.

    It was determined that on August 10, 2023, at approximately 4:30 p.m., a four-year-old child sustained an injury to the forehead with a toy block that was not in good repair. Staff statements indicated that the block that hit the four-year-old child was chipped at the corner with exposed pieces of wood. A staff member was positioned near the child and witnessed the other enrolled child throw the block, however they were unable to prevent the block from hitting the child. The child received professional medical treatment.
