591-1-1-.03(9) · Rule 591-1-1-.03(9) requires center staff to refrain from engaging in, or allowing children or other adults to engage in, activities that could be detrimental to a child's health or well-being, such as but not limited to, horse play, rough play, wrestling, and picking up a child in a manner that could cause injury.
During an investigation, it was determined that on December 2, 2022, at approximately 2:06 p.m., during naptime, a staff member awakened a three-year-old child to use the restroom. The staff member picked the sleeping child up to a standing position and removed their hands from the child before the child was stable on their feet causing the child to fall. The child sustained an injury to the lip as a result. Professional medical attention was obtained.

591-1-1.03(10) · Rule 591-1-1.03(10) requires center staff routines for children. Personnel shall provide routines for toileting, eating, resting, napping (depending upon the age of the children), intervals between activities and doing school homework, if any. Staff shall assist and encourage each child to become independent in the development of self-help skills, such as washing hands and face, dressing, eating and toileting.

Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty-six (36) months of age and younger.
During an Incident Investigation Closure conducted on August 10, 2021 ; It was determined based on investigative findings that on July 26, 2021, a three-year-old child was not properly supervised when the child's finger was injured in the door, during early morning drop off. The child received professional medical attention. An adverse action was previously issued for this rule violation. This rule violation is no longer appealable. No fine is being issued at this time.

It was determined that on July 26, 2021, during early morning drop off, center staff failed to properly supervise a three-year-old that closed the classroom door on their hand. There were two staff members supervising 16 three-year-old and four-year-old children in the classroom, during early morning drop off. On the date of the incident, one staff member was seated with their back towards the door supervising the children in the block area. The other staff member was seated in the direction of the door, with a bookcase blocking the view of the children standing by the door, which caused the staff member to be unable to see the three-year-old child leave the classroom. The three-year-old child closed their finger in the door and cried out. The staff members heard the child cry and immediately walked to the child and assessed the child’s finger. The staff member administered first aid. Professional medical attention was received and the child was diagnosed with a fractured finger.
