591-1-1-.03(9) · Rule 591-1-1-.03(9) requires staff shall not engage in, or allow children or other adults to engage in, activities that could be detrimental to a child’s health or well-being, such as but not limited to, horse play, rough play, wrestling, and picking up a child in a manner that could cause injury.

During an investigation, it was determined that on April 30, 2024, at approximately 4:30 p.m., a five-year- old child’s left pinky fingertip was partially amputated due to the finger being closed in the bathroom door. There was one staff member and a therapist present in the classroom with five children present. The staff member was engaged with the children watching television. The therapist was working one-on-one with a child at the time of incident. The five-year-old child was redirected to sit by the staff member as the child participated in rough play by hitting the children with toys. The five-year-old child stated that they needed to use the bathroom and ran to the bathroom. The five-year-old child repeatedly opened and closed the bathroom door with force. During the rough play, the staff members sat and witnessed the child’s behavior. The staff member failed to physically redirect the five-year-old child as the child engaged in rough play activities. The five-year-old child slammed their hand in the door. The child obtained professional medical attention for an injury to the left finger.
